should traffic camera tickets be reported?

    Hello, I need some advice. I've had a local job delivering oxygen for a little over a year now, but I'm looking for trucking jobs currently. My truck is a CMV, because it's hazmat. My city has these red light traffic cameras, and one of them caught me making a right turn on red w/o stopping. (actually, I had the green arrow, but it changed, I tried to beat it and didn't make it) This was in my work truck. My company paid the fine. My question to you all is: Should I include this on job applications? It's my understanding that one of these citations from the cameras is more of a civil offense. Our fine city is collecting the fines, and they have some out of state company collecting the fines for them. These offenses don't get reported to my state's MVD apparently. I checked my record the other day, and it's still clean. I only have about 4 1/2 months previous experience driving for Werner so I know any tickets are a black mark on my record as far as looking for a new job. I'm wondering if I can just let this one go, because don't the big trucking companies just go off of your MVD and DAC records? Do they actually contact your previous employers directly to ask about tickets/accidents or whatever? I know it probably looks like I'm trying to withhold info/be dishonest, and I'm really not that type of person. I just figure, why put something on an application that makes me look bad, when it wasn't necessary in the first place. Any help would be greatly appreciated. Thanks.

    Make sure you include it on any application. Any omission on your part can be construed as: Well, what else would this person lie about? Any reasonable company you would choose to apply for, when they see it on your app will just ask you the circumstances. The ticket itself is no big deal but....if you don't list it and it does come up, it will look bad for you. If you can't remember exact date, "round about" is fine.

    If its just a civil penalty just pay it dont worry about it ,
    Youl give yourself A heartattack worrying like that.
    But like you said make sure you read/check the ticket /penalty your driving record just the same. S ounds like you have done so.
    I wouldnt tell anyone about a civil penalty why cuz no one cares they want convictions.
    And one ticket isnt a black mark but a sign for you to be extra cautious its the three year period carriers and insurance companies worry about.
    get enough tickets and you get a unscheduled vacation

    It's a moving violation and must be reported. See FMCSR §391.27

    Be honest and list it on your application. Since you drove a CMV especially with Hazmat, and if you would like to transfer to another driving job, trucking companies by Federal Law must verify at least three years of employment. I can almost promise you, that the company you are looking to get on with, will send a form asking about tickets, accidents, and they ask if you violated any drug and alcohol policies. It may not be on your MVR or DAC . A lot of companies that run local routes do not report to DAC. But, if they are sent that form, they will fill it out and fax it back to your new employer. If you did not list it, they can terminate your employment or not consider you as an applicant.

    Think of it this way. If you put it on your application, and they tell you because of this incident, you no longer qualify, they were going to find out anyways.

    It's an insignificant ticket.
    Report it...as you should by law anyway.

    If that's all it takes to miss or loose that job...that place wasn't for you anyway.

    Thanks everyone for your input. I was leaning the whole time to reporting it, but I thought that because it was caught by one of those "big brother" cameras, it might fall into a gray area there. I spaced that any moving violation must be reported by law. Thanks for setting me straight.:biggrin_25519:

    That's right. You are in no way obligated to report those. Camera tickets are not reported to your state's DMV, and therefore do NOT go on your record.

    The reason for this is such tickets are not sent out to the driver. They are sent to the registered owner of the vehicle, because there is no way to determine who exactly was driving the vehicle.

    Also, if someone else is driving your car, runs a red light and gets their picture taken, you also get the ticket even though you weren't driving, because you are the registered owner of the car.

    However, if you receive a citation from an officer for running a red light, with your name and signature on it as having received it, you WILL have to report that, because that WILL go on your record.

    Everybody compains about the proliferation of red light and speeding cameras, but I say let's have them, for 2 reasons. First, as I stated before, camera tickets don't go on your record. Second, this will free up the cops to go after real criminals.

    I think you're spilting hairs with §391.27 but you may have a point since the ticket is mail to the vehicle. But then again I also believe they can hold you to the regs if they choose to. I think a new §391.27 should be written to cover this subject.

    Then what do you think would happen if a prespective employer would send a form to his current employer and ask: Has this driver been issued any tickets? They fill out the form and say, "Yes, John Doe, got a ticket for running a red light on January 1 2006.
    How would he then respond if he checked NO for ANY tickets on his application. DUH, URRR UHHH, I didn't think those count.
    If they ask on the application do you have any moving violations, he should list it because he did. I am sure when his company confronted him about it, he did the right thing and admitted it. Its better to tell the truth, and get hired, instead of lying, and getting fired!
