Skyview Farms continued harassment

    I would like to talk to any drivers who have had issues with Skyview past or present. This company has been a thorn in our sides nearly 3 years after the fact & I want to hear from anyone with sullied DAC reports from them.

    You don't need to prove malicious intent. Technically, by law an employer is only allowed to share certain information regarding a past employee. Dates of employment and whether or not the employee is eligible for rehire is the norm. I was in the hotel/restaurant business for over 25 years before I returned to trucking and I took a lot of calls from employers looking for references from applicants that were former employees. Our company (a Fortune 500 corporation in the hospitality industry) made it very clear that we were NOT allowed to share any information other than what I have already mentioned. To do otherwise opened us up to legal recourse from the former employees.

    If you can prove that this former company is exchanging information other than what I have mentioned, then you certainly may have a legal course of action to pursue. One thing I would do immediately is contest any negative reports on the DAC as those are generally (and routinely) dismissed as soon as there is a complaint lodged by the person/persons that are affected by the complainants.

    Thank you Chef got the prompt replies & useful information. I have 8+ years in the legal arena but this is my first go round within the trucking world. My family owns a fleet so I am familiar with the industry but have never run across a company so vindictive this long after parting ways with a driver. I already have my fiance disputing the DAC information but I would like to make sure this company can't harm any other drivers this way. I love this industry and companies with unethical and/or illegal practices are giving it a bad name.

    It just amazes me how they get away with destroying drivers livelihood .. I am the fiancé spiritwolf is speaking of I put the $1500 dollars down in fact it took me a month to save the money... I started in December of 2010 drove my personal vehicle to the orientation ... Things went ok for about 3 or 4 months then started noticing money missing from my check and started questioning it then they made up an excuse to shut off my advances and the severely negative paychecks came about there excuse was they weren't getting my paperwork this went on for about 3weeks and I called bob and asked for an advance on what was owed to me ..at this point I was getting sick I had come down with the flu... He told me that he couldn't advance me money because skyveiw isn't a bank .... Two weeks later I went home to try to get over being sick which they made me deadhead from Pa 500+miles then while at home in bed sick they came towed my truck away with everything in it ,,, shortly after they had the city come take my car away for junk because I couldn't get out to Nebraska to retrieve it .... That was three years ago ... If it weren't for the fact I needed that job I would have saw the red flag when Koby told me during orientation that if I crossed him he'd make sure Id regret it for the rest of my life... He said I'd b lucky to ever drive again... Now in the search for another job and one of their reps is calling potential employers and telling them I stole $20,000 from them and has posted on my DAC miss use of company funds

    They actually do this so much they have a driver who's main job is to drive or fly all over the country to retrieve trucks ..... That is really sad

    I read your story JKR. If what you say is 100 truthful then this is an atrocious company.The one thing you said that sticks out in my mind is this:

    You are saying that a company told you that during orientation? If a company told me that during orientation, I would have walked out no matter what my circumstances were. Something here is just not ringing true to me....That being said, if a company reports inaccurate info on your DAC report, they have to be able to back it up with proof or they could be fined $10,000 and lose their DAC account. It is right in the contract when you sign up for HireRight. ( I know this because my son is a safety director for a small trucking company) According to what he told me today, HireRight does not allow vindictive info to be posted since they took over DAC. If they do, and you file a complaint, HireRight will remove the post from your DAC. If the company has documentation and proof that what they posted is true, the company has to send it in to HireRight for review. Then HireRight will make a decision.     Already taking care of it and going through the steps to have them investigated ,fined and shut down ... They have been doing this to way to many drivers and it's not right ...it's companies like them that give the industry a bad name ... They have already been sewed and lost for some of the same things (Phipps vs Skyview farms )

    I don't wish anyone harm or misfortune. I just want them to recant the false allegations and stop harassing him. But if they are doing what I think they are, then jail may be appropriate.
