    I wonder how many drivers are sent to sleep studies then told they don't have apnea ? Probably not many .

    From the ones I hear of, quite a few. Sleep apnea is the new medical flavor of the day and health racket. Here in Ohio a few places drivers have gone for their dot physicals,based on discrimination (bmi) have been told to get a sleep study and a temp card issued to drive on.This is not a state law,nor federal. All someone has to do is just go to another place to get a physical but loses on whatever the first one cost you. From experience and checking, Urgent-care does NOT participate in this discrimination/racket. I am sure there are more.

    No , quite the opposite . We need those that were sent needlessly to speak out more and show BMI and neck size are not justified reasons to recommend a sleep study .

    One the requirements of electronically filing the medical info on the CDL take effect the option of a second physical will end .

    Where there is a will,there is always a way. Plus a few green backs in someone's palm never hurt either. ;)

    Nevertheless, the largest population of folks who legitimately test positive for sleep apnea have high BMI, and a neck size over 17 inches. Granted, it may seem as though folks are being unfairly profiled, but the facts are there. None of that means that people who are skinny as a rail aren't immune from this.

    A discrimination lawsuit will simply mean that *everyone* will have to get (and pay for) a sleep study before being hired.

    No it will make law makers as well as companies back off the issue altogther. No one wants to be called a bigot after all.
