So i guess i'm "banned" from the Vegas TA

    She probably was the manager on duty... The lower level people were probably cleaning the bathrooms and talking out trash. I'd say it was worth the loss 13 bucks.
    I probably would have just smoked them back when I smoked... lol

    Picture taking aside, a business is not public property. That includes the store and all the grounds, including that parking lot, that is owned by said business. Having spent more than a decade in management, I am well aware of trespass laws and what can be considered trespass. If the truck stop was not posted no-trespassing (which would be highly unlikely if it was) the picture taker was not technically trespassing until he was asked to leave. However, if he refused a request that he leave, then he’s trespassing and a call to the police could have resulted in an arrest if the property owner or manager requested it.

    I'll give you an example. In the business that I managed, we were in a small strip mall with very little parking. Across the street was a sandwich shop (very good food, by the way), that would constantly be packed over lunch hour. This presented parking issues and we would have people parking in our parking lot and causing us problems.

    It was a daily occurance that we'd have to tell people they could not park there, but corporate would not authorize a sign explaining it. Most of the time, people were fine with us telling them they could not park, even if they might have been a little miffed. We had one gentlemen once that was a regular at the sandwich shop and would park in front of my store, go get his sandwich, then come back and eat it in his car. He was not fine with it and after ignoring my requests two different days, I called the police.

    The person was arrested for trespassing because I told the officers that he had been rude and would not heed the requests we had made. When the man loudly objected and 'cited' his rights, the arresting officers words were along the lines of "I don't know what lawbook you own, but you should throw it away. This is a business. It is not public property. You do not have any 'rights' to be here, especially if the manager is asking you to leave."

    Cops are given some leeway in handling non-violent trespassing issues, but ultimately it falls to the owner or manager in cases like this. In most cases like this, they would likely ask if the owner or manager if they would be satisfied if the trespasser was simply asked to leave, which is usually what happens. But if the owner or manager wanted to be a jerk about it or was tired of being ignored like in my case, they could say no, they want him arrested and the cops would have to do it. What happens afterward, depends on the person arrested, past record, the judge’s mood, etc. and has no bearing on this thread. The guy in my case spent a couple hours downtown and then had to get his car out of impound after we had it towed, all because he was trespassing.

    If you want to stand on public property, go to the park or the courthouse or stand on a street corner or in the road. That is public property because it’s our tax money that funded said building. Your tax money didn’t fund the truck stop or the restaurant or the grocery store. It's a business and business are private property, even if they cater to the public.

    And all that does not even touch on the fact that taking pictures of a bunch of trucks in a truck stop parking lot isn’t the smartest thing in the world anyway.

    I didn't say i was proud of it. Probably the first time I blew up in 10 years.

    I was tired after running straight from IA to Houston on about 3 hrs sleep.

    She could of exchanged them no matter what the law was. It was her error to begin with. Like I went outside and poisoned the cigarettes in a minute is totally absurd.

    I kinda felt bad afterwards because that wasn't my normal behavior. But now I don't, it happened, it's in ther past, she's a #####, and now I can laugh about it.

    In this case, i'm going to favor the clerk. Because the law (while questionable) is not overly unreasonable; If she said, " I can't exchange the cigarettes because the law says we can't exchange cigarettes for black people" or something like that then yeah throw a rock at her dam head! (for going along with something so stupid)

    But it wasn't the case. In this case, speak to the mgr on duty. Or file a lawsuit against the state of Texas! Or enact new legislation.


    i think the so-called "blue law" in the south is absurd. But the way to handle it is to act like an adult, not take it out on the clerk who didn't make up the law/rule.
