yeah, thats much more organized to see each states one/two party law
-
Interesting part is the phone call crossing state lines.
If one party is in the 2 party state, it presents more problems.Faber Thanks this. -
gotta go.....be interested in what you guys find
-I would be inclined to think that you could record audio/video officer stop without consent based on four things;
1). the officer initiated the stop
2). it's in a public place
3). i would think it would fall under some type of 'right to defend yourself' as in eveidence for your side of the case
4). dependent on state possibly, they may be recording you without consent
But it's the possible state by state arguement thats throwing me a bit....
oh and to the federal law level, certainly was never meant to be a private interaction.shredfit1 Thanks this. -
Guys, has it occured to you too that you all could be scaring the hemlock out of some lurking, phone shark, dispatchers that thrive on pushing you to 'doctor' logs for a 'hot' load... via the phone
Dispatch: "Make the run or else!" Driver: "or else what"? Dispatch: "or else you'll have sheeet runs the rest of the month"! Driver: "that sounds like extortion via blackmail". Dispatch: "call it what you want...but that IS what will happen...unless you do as I say..." Driver: "Sorry, no can do" Dispatch: "curses & hangs up". Driver: "Presses end record"
Faber Thanks this. -
everything i've come across says as shredfit originally said, that recording a stop without consent is kind of a 'up in the air thing' and varies state to state, of course any issue allevable by notification of such recording....
-so regardless you could legally do it if you notify (and escalate an situation by nature of the act)....but as far as 'having to notify' it would be varient.....
#### it I hate it when I can't come to a totally solid conclusion on something on my own.....it eats at me.
then you get into pubic property and 'not intended to be private' interctions....it's making my head hurt, ha!
I'd do like the other guy said and just slap a sign on my door....then do whatever I want whenever..... -
Whereas, an officer would be informed/consent that you were indeed recording what was transpiring.
If the officer didn't like it or objected... the officer would have choices
1) He/She could obviously leave.
2) Call a superior/supervisor to the scene to take over...
3) Continue the stop... being recorded
I'm also really interested in this topicFaber Thanks this. -

I am thinking about them again because dispatch likes to use the phone to push and keep it off the qualcomm. Safety also says not to use the phone, but dispatch calls. -
I have reviewed several of the recent posts, but not all, so if I cover a covered topic please let me know. I "believe" you are allowed to record with both video and audio the inside of your private car/truck or domicile for private use without giving notice to the public. If an officer walks to your window and speaks to you and the video isn't directly pointed at him, the audio is admissible in court for defence. Granted there are several different laws in reference, federal, state to state, and all the amendments and loop holes. So please consult a lawyer before you set up a system. Some web sites will quote specific sections of the law, but not the whole law to boost interest in the quasi legality of a products.
Hope this helps, Truck safe.

P.S. A gentleman down south set up a high res. video feed of the river, in the path of the video feed was the undercover entrance to the jail. Membership sky rocketed, cops found out, Fed's showed up, major stuff happened. Be carefulFaber Thanks this.
