Well yes and no.
I learned recently that this isn't the case in a regulated industry.
I was told I can ask anything that has to do with the performance of the driver like issues with accidents and incidents.
If asked I could provide specific information that could go on a DAC report or could be on the MVR/other records and talk about the performance of the driver related to business issues.
What I can't do is trash talk the driver, impune his/her reputation or purposely try to damage it.
So, what of a driver applicant’s record can a carrier see?

I have always heard that you as a representative of a past employer can tell a prospective new employer anything that is true and has a bearing on the job. In a way, it's like the various libel and slander laws in the US. It's not libel or slander if it is true. As I was writing this comment I was thinking about something a friend told me who works in the Crete HR dept. Crete fired a driver after repeated warnings about being late and missing appointments. Otherwise, the driver was a model driver. No log issues, no speeding tickets, and had nothing much on their DMV. It looked like the guy just was a horrible planner and did not productively use his available hours. After several conversations with him after missing a pickup appointment they brought him to a terminal and fired him. When they were contacted per part 391.23 they listed him as terminated and do not rehire. Then they were asked for more information they told them about his penchant for being late for appointments. This friend told me they wished him well and hoped he found a better fit with this new carrier.

I applied to a company a couple weeks ago and they used Driver IQ. Most detailed report I've ever seen. And yes Schneider did put a preventable non dot reportable incident of tearing off my bumper on a boulder 17 months ago.

If all the application asks for is accidents I would write no DOT reportable accidents, if it asks for incidents, then you should give up the minor stuff that you did without being specific unless they ask during a follow-up.
