Some Advice

    I recently gradutated from school at the end of oct/november....and im having a tough time getting a gig, because i was drving home one night (feb '05) on a very windy night thru the mountains(PA)....I was driving a very tiny car(topez) and basically the wind was shaking the car. Before i continue with the story let me say that i was not sleeping at the wheel nor do I cunsume any alcohol at all...not even on special occassions and even if i did i wouldnt drink and drive.

    anyhow an officer coming the opposite way pulls me over, says that my car was swerving.....i tried to explain to him that the wind was giving my car a tough go.....i guess he didnt buy it and asked me to get out the car and made me walk in a str8t line and a host of other stupid things..... i passed every test obviously cause i wasnt drinking...

    he lets me get back in my car and says he's giving me a reckless driving charge. i ask why...i never crossed lanes onto the opposite traffic and i wasnt sleeping at the wheel. He says that children could run out onto the road....(in the Fn mountains....like mountain on one side and river on the other, no houses, no walkways). so i get the ticket and i plead not guilty...i goto court...(i received some other charges from him but dont remember what they were called...basically he gave me the same ticket under diff names- not speeding i know that one)...when i get there the judge says the officer is going to offer me a reduced sentence....and drop every thing but the reckless driving, mind you im a broke college student who hasnt the slightest idea what reckless driving even really means...to me it was the difference in a hundred or so dollars..being as i had no money...my uninforned butt was like whatever....now i know that ignornce of the law is no excuse...but at the time i never thought id have a cdl.....

    part 2, I attended a very good trucking school and i wont call them out on the boards even though i should because they were very good to me minus this one point....when i signed up to attend the school they only told me i need a 3yr motor vehicle report which is only has 1 violation...for going 65mph in a 55mph zone on the highway (June '06) asked me was i a felon and the like saying the fact that i wasnt makes me very hire-able

    you can say that i should have known..ok. But what i dont understand is if the industry standard is 5yrs why only ask for a 3yr MVR for entry in the school...like we wont train you unless you have a suffice driving record. i had no idea that companies want 5yrs for DUIs and Reckless driving. I lie to you not i was not reckless driving, to this day outside of getting caught in the wind...i dont have a true understanding of what would get you a reckless driving charge.

    so here i am fresh out of school with a oppertunity to drive for FED-X straight out of school...i walk in the lady asked me what school i attended, shes like we accept students from that school. she is talking to me like i already have the job plus i had inside connect(another kid from my school was driving for someone and told him about me and he said he'd consider taking me)...

    so im geeked right everyones telling me that FED-X is a good comapny...im stoked....lady calls me Monday...im so pleased to hear from her...and she's like you cant drive for us...im like, can i ask why is that....she says that you have a reckless charge on your record im like i gave you the same 3yr MVR i gave the school...it doesnt have reckless driving on there.....she's like we go back 10yrs.

    im not even remembering what the charge was they gave me....but im like i was never reckless driving, shes like well it says here that on this date you were.....i see the date....all i could do was just say - nothing - speechless.

    I called the school im like do most companies go back 5yrs on your report...shes like yes....i ask her very respectfully, then why is your standard only a 3yr MVR. she's like some companies have higher standards than other....

    all the companies that ive researched that i found that i would like to consider working for all have the same policy...ive filled out the online apps anyways and tried to explain the situation....can anyone help me figure out where to go from here.....i praying i didnt just waste $5000 for a fancier license.....i aint got money to blow like that....please tell me all is not lost.

    i dont not have access to a comp at all times right now...so forgive me if i dont catch your response right away...but i will check back in when i can...any advise that anyone can provide me would be most helpfull.

    You shoulda lawyer'd up b4 you went to court to get in reduced to n e thing but a reckless. You should call a lawyer to c if there is still n e thing you can do. otherwise im not sure you can get a job with that being so fresh on your record. Its all about insurance my friend not so much if at all the trucking companies. You should look into working for the county plwing snow or hauling trash, n e other jobs you can think of till that 3 yr mark goes by. best of luck. there r more jobs out there that require cdls other than otr companies.

    Have you ever heard the old adage that he who defends himself has a fool for an attorney especially for such a serious charge.

    The federal standard for motor carriers is 3-years on an MVR when checking that document. Nothing in the rules says that a carrier can't require more, but they must at least look at the minimum. Plus, Reckless is a serious offense under 383.51, memory serve. And under the FCRA (Fair Credit Reporting Act), a federal law regarding consumer reports (an MVR falls under the FCRA because it is a consumer report) the reckless charge may remain on your MVR for as much as 7-years. Most if not all motor carriers worth their salt will not hire you with a reckless conviction in the past few years.

    But the carriers have the right to determine how far back they wish to look at an MVR and within that period adopted by that carrier what they will, or will not accept so long as they at least look at 3-years.

    You forgot the EHHHHHHHH. And once he was convicted there is nothing an attorney can do to reduce the charge because it's already a conviction.

    I feel bad for him, wasting all that money getting that cdl. Im sure he can find some other driving job like plowing snow or running a box truck full of milk or something. lol. He shoulda fought that charge kicking and screaming in court. Especially for a 1st offense.

    Keep checking around. You may have to work for some dog of a company for a few years, to get past this. But you will eventually find a job.

    Right now, every company is going over every applicant with a fine tooth comb to reduce cost. Insurance, cost money too.

    Mark this one down as a costly lesson...NEVER go into court alone.

    You should stop applying for driving jobs asap! Don't get on to many companies record books as declined due to your RD conviction. Next, you need to realize that only alcohol related incidents remain on your driving abstract for over 5 years. Thus, in two years you should be clear of the RD charge and ready to work for the company of your dreams. However, in the mean time, grab a scrap of cardboard and stand on the corner and say your a "Swift Driver - anything helps, God bless" Who knows you may end up making more money this way and never have to drive again.

    it doesnt show up on my 3yr report.....

    anyhow....i will look into some county jobs....tho i havent driving anyhting that needed a CDL since i passed the road test....

    so basically im not going to be able to find a job is what everyone is saying?

    so im confused should i keep applyin for jobs or should i stop....

    also it happened in Feb of '05 so its 1yr away from 5yrs...but whats gonna happen to my cdl status in the mean time if i cant find a job...like i said i havent driven anything that requires a cdl since late Oct. '08
