    I have a question about the split sleeper berth rule.

    eg.

    I pre-trip at 8:30 am. At 6:30 pm I have 7 hours driving, 1 hour on duty, and 2 hours off duty.

    10 hours of 16 gone. I have a six-hour window and six hours driving time remaining. I take 3 hours in the sleeper while I'm being loaded.


    Do I now have a three-hour window remaining, or a six-hour window?


    Does the 3 hour SB "pause" my 16 hours?


    The rule is a bit ambiguous.


    • In the time before and after each period:

    • The driving time does not exceed 13 hours,

    • That there is no driving after the 14th hour on duty; and

    • The elapsed time does not include any driving after the 16th hour.

    • So it says that in the time BEFORE and AFTER the elapsed time does not include any driving after the 16th hour. So is that the 16 hours before and after, or the 16 hours from shift start?

    The 3 hours in the berth stops the clock leaving you 6 hours. Your 16 hour window will now end at 03:30.

    If you then spend 7 hours in the berth you will have 8 hours available to work, 7 of which can be driving and your 16 hour window would then be up at 8:30 pm.

    If you take a full 8 hours instead of just 7 you will have reset your work shift and will have a full 13/14/16 available though you would need an additional 2 hours off duty prior to midnight so as to not exceed your daily limits.

    I've had three different theories from two drivers, a safety and log trainer, and a DOT Inspector.
    Two of them agreed with your..an my, by the way...take.

    The three hours stops the clock. Any time before and after the 3 hours must be counted. So 10 shift hours before it leave 6 shift hours available. 8 on duty hours before it leave 6 on duty hours after it and since you had exactly one on duty hour that wasn't driving all six of the duty available can be used for driving.

    If you then take 7 hours in the berth the six hours of driving from 9:30 pm until 3:30 am need to be counted so that leave 7 driving hours available after 10:30 am, 8 on duty hours and a ten hour window.

    You can do that over and over as long as the time before and after the period in the berth does not exceed the 13/14/16 limits and the time in the berth when combined with the previous sleeper berth period totals 10 or more hours.
