Stalking order worse than a felony?

    Back in 7/2004, an ex-girlfriend accused me of stalking her. To the contrary, I was trying to push her away. I was actually in a new relationship with a woman (who is now my wife). However, the ex-girlfriend heard of this and tried to come back into my life and I rejected her advances. I think she retaliated and filed false stalking charges against me. We had our hearing in court and the judge sided with her and her scummy "witness". Of course, there is no evidence presented nor needed, the judge simply makes a decision based on testimony.
    Fast forward to today. I try to get a spot in cdl training with Central Refrigerated but am told that a stalking order will keep me out of their program. Yet, an ex-felon can get in no problem.
    This all makes me sick. I can't appeal that stalking order since that option does not exist and the order is effective permanently. It isn't fair. A convicted murder has the right to appeal but I can't. And, a stalking order is neither a misdemeanor nor a felony.
    Excuse my rant. I just had to share it to see what options anyone can recommend. I may approach the ACLU of Oregon to see if they can sue to change the laws. I should have more rights, yes? It shouldn't be a permanent order that shows up on a background check. Nothing so severe happened that I should be punished for life yet felons can have better opportunities. Just sick.

    So if I am understanding you here, there is a permanent restraining order against you? But no criminal charge? Is this correct?

    It sounds to me like your next stop is either an attorney, or blow off Central, (which seems like no loss from what I have heard, though I've never worked there,) and try someplace else. Why don't you try a different company before going to the trouble to contact a lawyer. If you get the same result, you probably need legal advice.

    THAT IS NOT THE SAME as a "truck stop lawyer.":biggrin_25523:

    Protection orders in most states are typically good for a maximum of one year, although in some states for special situations including stalking they can remain active for up to 5 years. Permanent orders are usually only issued at the conclusion or disposition of a case, so if you have a permanent order against you then it is likely there is more to the story. If there is not more to the story it is unlikely you have a permanent order against you. Consult an attorney and find out. You can also have an NCIC check run and see if it shows up. All protection orders should eventually be entered there.

    There really isn't more to the story. However, I have suspicions. One of my ex-girlfriends boyfriends is a cop. I have a feeling that she contacted him and he showed her how to really stick it to me. And, she admitted to me (while we were dating) that she had to place a stalking order on an ex-boyfriend. So, I think she does this sort of thing to guys.
    I'm trying to get on with Swift or FFE. Hopefully something comes through soon.

    try suing her for defamation?

    Try to obtain a copy of the order?

    And of course, lawyer up.

    You should take the advice of a previous poster and apply to another company and see if you get the same result.

    But don't apply to the one that you REALLY want to work for because if you do and they deny you, you might not ever be able to get in there.

    Apply to a company that you'd kinda like to work for and see what they say and if they say the same thing then get the advice of a REAL attorney to explore your options.

    That way you can hopefully get this cleared up before you apply to the company that you REALLy want to work for.

    Here is the way a company looks at it. You stole something or sold some dope years ago, well, people do dumb things in their youth. You have a record of stalking...you are now a vengeful weirdo, that has a posessive, vengeful personality, and can't control your emotions. You really think they are going to hire you when they think they may be the next people you stalk. And, many stalkers end up commiting murder.

    That is what a company is thinking when they see stalker.

    Years ago the owner of the company and the dispatcher was the same person. Sometimes they had an employee next to them that dispatched. Either way, you knew exactly who to punch in the nose.

    Oregon stalking is a Class A misdemeanor. If violence is involved it is a Class C felony.
    Stalking involves more than one unwanted contact and usually involves somebody stalking another person they aren't or haven't been in a relationship with. If it is a relationship the judge will usually just issue a restraining order. The stalking order can be a permanent order unless the court vacates the order, which they are not real inclined to do. You needed an attorney when you originally went to court. You REALLY need an attorney now as this will follow you the rest of your life and if the ex wants to have more fun all she has to do is call and say you contacted her again and you go to jail.
