Yes, if you change your domicile to another state.

Here's something neat I learned recently. DO NOT REVEAL ANY MEDICAL PROCEDURE OR INJURY ON YOUR MEDICAL QUESTIONNAIRE, unless you received worker's comp payments, then I'm sure they'd have a way of finding out. Otherwise, your body is perfect and you've never even been to the doctor for anything! The Terminators in the hiring department are just looking for a reason not to hire you, and they can't be reasoned with.

The HIPAA laws--that I forgot about--prevent anyone from digging into your medical record without your consent. The trainer at orientation told us to put down everything because if they found out you withheld something, they wouldn't hire you. So I decided that I had better play it safe and list a couple of things that I really didn't have to, having answered the questionnaire 100% honestly the first time.

I fessed up to an elective, outpatient hernia mesh surgery that I had 10 or 15 years ago, and what turned out to be a non-permanent neck injury courtesy of a quack chiropractor, and that really dumb honesty cost me a very good job with regional flatbed company.

So, lie. Lie like a rug. Honesty is punished. Deceit is rewarded. One of the guys who got hired told me he had TWO hernia surgeries but didn't disclose them. Smart guy.

    But I'm not bitter. :D

It's funny when they think they're being so cool. Leaned back in the office chair and asking questions.
"When I was younger, smoked some pot every now and then. We all did it in high school. They were the good old days weren't they?"
"Yep, I haven't smoked weed in a few years myself."
"Sorry, we can't hire you; goodbye."

One of the forms you signed prior to getting hired gave the company your consent to ignore HIPAA. It was probably the same form that gave consent for them to ask past employers, creditors, and others about you.

That’s a negative, ghostrider. I went back and reread all the stuff I signed for both Cypress and Stevens. Nary a mention of HIPAA. Nada.
