At least in OH and PA, the rule is that the shop/store has to take it on faith that you're tax exempt. You fill out a form, and then they file it with the state.
TA requires it to clear their 'corporate' offices, before you can start being tax exempt (although I explained to the first TA in PA I dealt with and they removed the tax anyways). Each state requires you to submit the form with each shop. They then keep it on file for all future purchases.
You are required to use YOUR MC# on the forms. If you do not have your own authority, then you don't get tax-exempt. If you haul under someone's authority, the bill must be in their name and they will have needed to fill out the tax exempt form with that shop.
That's why the bill must have LANDSTAR written on it, because it's their authority that's tax exempt. They can't bill it in your name and be tax exempt. You don't have operating authority.
I had this problem before I was under my own authority, I'd buy parts for my truck, but had to pay tax, while my previous carrier would get billed with no tax. I never knew why at that time.
As for EIN, for OH and PA, the EIN isn't the issue, it's the MC#. That's what grants tax-exempt status.russellkanning and landstar8891 Thank this. -

Your EIN protects your SS# when you do business with people (it's also used for corporations and LLCs if it's not sole-proprietorship).
I just have a DBA and have an EIN. Whenever someone needs a personal identifier, I give them my EIN.landstar8891 Thanks this. -
The only time my EIN Number is brought up is when i pay the HUT.I do it in person and sit down with the lady at the desk..Outside of that i use it in NY at the parts store or the repair shop when i fill that paper out..
