Stuck at a shipper with no driving time left

    I still think that it is the carrier/driver responsibility to perform their task in a legal manner, within the confines of whatever rules the receiver has.

    I sometime see an attorney where I occasionally eat breakfast. I think she practices this kind of law. If I can I will ask. Yes I know my example was ridiculous. However your example of a drunk leaving a bar is also not a good one. A person leaving a bar over the limit is violating the law in regard to their fitness to drive. In the case of a trucker out of hours you would have to establish you were unfit to drive safely if out of hours. While it is illegal for you to drive a CMV there is no law that says you can't drive an automobile. I know there is a big difference between a car and a CMV. Another problem you might have is your knowingly entering the Costco property knowing you were this close to being out of hours. Like I said I am not an attorney, but I do know before you can win some lawsuits you must show you did everything possible to limit your damages. There is so many different ways a smart attorney can go at this that I honestly don't think there is any hard and fast solutions.
