suing a broker

    How much money would you sue them for? It sounds like you are saying you were incorrectly deducted 6% of the rate, so I'm guessing somewhere between $60 and $240 depending on the lane?

    Might be able to file against their bond, I'd just double check the fine print to make sure you have something in the rate con or the setup packet that confirmed it had to be ACH payment.

    First what does your lawyer say?

    Second ... do you have written proof when you either delivered a load or accepted the load that you wanted to be paid in the method you selected?

    I don't mean on the phone, I mean emails or text messages.

    If so take it to small claims court and have it adjudicated. He most like would send you the 6% in the mail in a check rather than to go through the hassle of appearing in court for the money.

    Which ever way, do not work for this broker again, create a NO HAUL list and put his/her name on it.

    Yes I do have proof of our payment agreement that I filled out via the carrier portal link he sent me. I got a copy of the agreed on terms. It clearly states that I allow broker to deduct a percentage if I selected quick pay via the “my carrier portal” which I did. It doesn’t say on anywhere he can deduct a percentage of my pay if it is via a check. Last night I went and got on the “my carrier portal link” he sent me when I signed up with him.
    i have a email from his colleague, telling me “hey Maria I informed the team on the 1 day quick pay” I had it set up on 5 day quick pay via ach but asked him to do 1 day quick pay via ACH. Because I needed the money instead they f**** me over and sent a check and took a big fee 6% , correct me if I’m wrong quick pay means direct deposit, ACH. It doesn’t mean mail out a check.
    I have a screenshot where I selected the option of quick pay and right next to it it says ACH.
    Last night I went into the carrier portal for this broker and he completely changed his payment options to “quick pay 6% 1 day” - CHECK quick pay 3% 5 day - CHECK, when I signed up with him it was set up differently it was set up with ach options.
    i will attach 2 pictures showing how he went and changed the terms. I’m sure he did this yesterday at night, because in the morning nothing had changed on the terms.
    I did not agree to those new terms, that he changed after I had already signed up with him. And we agreed on quick pay via ACH.

    It’s $325 dollars he deducted. I would sue them for that amount. It was a lane from Florida to Washington.

    I have the carrier packet that states I signed up for ach quick pay via 5 days.
    The day the load was delivered I let his colleagues know I would do the 6% via quick pay and his colleague sent me a saying “Hi Maria, informed the team about the 1 day quick pay.”
    I’ve attached 2 photos of our agreement stating he can deduct the applicable discount and fees if carrier selected quick pay option via carrier portal which I did. And it states ach.
    What do you think? I have proof where I asked him through email to please not mail a check out as it was not what we agreed on, I told him I was set up with direct deposit. And he ignored it. I feel like he did this intentionally.

    I'm fairly certain you can file against their bond and win, that second image clearly shows they should have paid you via ACH. I'd make sure to include as much info up front (including the two screenshots you showed here) when filing against their bond.

    I wouldn't waste 2 seconds of my life suing someone for a measly $325. I would lose more than that in the time it would take. Just don't work for them anymore.

    Yes I will file against there bond. You know I went into the carrier packet link they sent me and it seems like they erased my information I had put on there with the quick pay via ach. And now they don’t have those options they have quick pay via “check”
    I’m sure he did this after I told him that was not our agreement. I have a email he sent me saying “we have updated the information in our my carrier packets profile.

    It’s not about the money, it’s about the disrespect. I don’t want him to think he can get away with this and continue keep doing it to other carriers.

    They went from FL to WA for $5400, that $325 is pretty important. Lol
