Good points. I can't really speak to your situation. Well, I already have by saying I can't stand trying to work with those snakes. But I work regularly with other snakes. We're all playing Indiana Jones out here dodging snakes on the spot market.

To answer your question though, there's nothing that prevents a party from attempting to cancel a contract verbally but in almost every case of contract law that I've seen, the cancellation needs to be done in writing since it's an amendment to a written contract.
For a hypothetical, let's say you're hauling a trailer from NY to LA on a written contract. Once in KS, you decide you don't want to deal with it and you call them and verbally agree you're going to drop the trailer at the nearest trucktop in KC. You drop it and go about your business and then a few months later get a lawsuit in the mail. Now let's imagine the exact same situation but this time, they agree verbally and send a signed written amendment stating they agree to the trailer drop in KC. Which do you think will hold up in court? -
It’s understandable to feel something’s off, but remember Hanlon's Razor: 'Never attribute to malice that which is adequately explained by stupidity.' It’s possible that the situation isn’t due to any malicious intent. Sometimes, large companies like TQL have miscommunications or oversights, especially when dealing with multiple parties and complex logistics. The lack of a paper trail might simply be an error or a breakdown in their usual procedures rather than a deliberate attempt to cause confusion or harm. While it's frustrating, it might be more a case of disorganization or oversight rather than anything fishy.
That said, my guess is that if it was intentional, they might have been location shopping, and whoever handled it had a budget or bonus and was trying to keep all of it rather than pay a fair wage. -

Nah...If the load would have fallen through I would have stayed at the Wildhorse for the weekend, and grabbed a load Monday. I needed a break and I'm not keen on dead-heading 900 miles for the hell of it.
Applebees has 1/2 price appetizers twice a day every day from 3pm to 6pm and from 9pm to closing.Siinman Thanks this. -
Constant Learner and gentleroger Thank this.

You would've been way ahead of the game to just never hooked to the trailer and go on your merry way. Then file it away in the "I'll get em next time" folder. You could've gouged them when they were in a bind calling you up the next time.
But you can't now because you're in a mess where they short paid you on other loads. They've got a team of lawyers on retainer and don't care, it's only a headache for you. They just spent over $30,000,000 adding a running track and some gym equipment to their corporate headquarters in Ohio. -
