Yes, if they follow the plan from his SAP councilor. They can even use the pre-employment test as the first return to duty test so they will not even need two tests to get started. They just need a copy of the written plan from the councilor and follow it to a T.

Most companies don't take on SAP drivers that have not completed the entire return to duty testing, including follow up test, because they take on the liability for making sure the driver properly completes the process and if they miss a step the carrier can be violated for a frug program failure. SAP drivers are risky for trucking companies because of the likelihood of a violation reoccurring.

As for getting back into trucking without a 1099 scam, there are plenty of companies that will hire SAP or other second chance companies out there. They are hard to find, make need to make hundreds of calls and applications, but they are out there and better than a 1099 scam.

The way this economy is headed I would not do what you are planning.
As others have mentioned, find another outfit or a different occupation.

Go find a small construction company (asphalt, concrete finishing, excavating, etc.) that needs drivers to move their equipment. They seem to be a little more lax with their hiring criteria

What would stop someone from forming an LLC, filing for a DOT #, hiring themselves, sending themselves for a drug test, and proceed to drive for, say, Uber or do local trash removal, or whatever for three months? Just because a CDL is not needed, doesn't mean you can't have a CDL or DOT #. Process completed, driving history established, then close DOT # and get a W2 OTR job.

Close the DOT before you get your new entrant audit.

I believe the DOT# doesn't become active until process is completed AND your insurance becomes active, which is expensive.

It's the other way around. The return-to-duty test can be used as a pre-employment test, but a pre-employment test cannot be used as a RTD test.

Yes, that is correct. I should have stated it cleared in my earlier post. Thank you for pointing it out as I don't like even the slightest misstatement that may cause trouble later for someone.

If you're prohibited from taking the truck and lease onto somewhere like Landstar or jump out on your own authority as long as you keep making the payments, their plan is to pull the rug out from under you, then that light at the end of the tunnel turns out to be a train. Just my opinion though.

For the love of God do not sign a lease purchase in 2023, this is a surefire setup for failure.
Go get literally any other job and wait for the economy to rebound.
If no one is willing to hire you, that is your sign from above that trucking is not what you should be doing with your life this year.
