    I don't get it. The phone knows how fast your driving but does not know if the vehicle is moving.

    It can tell the person is traveling or moving. It cannot tell whether the user is actually driving.

    That isn't what the article said.
    In other words, the software is incapable of discerning if the phone owner is DRIVING or just the passenger.

    They make "phone jammers" that some movie theaters use (till they get caught). Jamming or actively interfering with a phone signal is a Federal Crime.
    You can even buy hand-held phone jammers to stop your annoying neighbor from going into explicit detail of his love-life while you are enjoying your favorite steak at the local Chop Shop, but like I said: don't get caught.
