Texas fatal- pickup slams trucker parked on shoulder

    "At 11:15pm Thursday Conroe Police were dispatched to a fatal crash involving two motor vehicles at 11790 N IH 45 North in the main lanes. A driver’s account and scene evidence were used for the preliminary investigation. The driver of a 1995 Freightliner pulling a trailer, had been legally parked on the outside shoulder of the main lanes for about 5 minutes entering GPS data. The deceased was driving a 1995 Ford Ranger northbound on N. IH-45 and failed to maintain a single lane, entering the outside shoulder and striking the rear of the 18-wheeler trailer. The Ranger was caught under the rear of the trailer and caught fire while the driver was entrapped. The driver of the 18-wheeler unsuccessfully pulled his rig forward in an attempt to dislodge the burning vehicle. Conroe Fire Department arrived and extinguished the fire. The driver of the Ranger was deceased at the scene."

    Legally parked on the shoulder to mess with gps? Parking on shoulder is for emergencies only.

    I only use the shoulder for extreme emergency. If I need to stop for whatever reason, I get off the off ramp and get back "ON" and park. Even though they say he was parked legally, the lawyers are gonna have a field day with his company.

    I do that a lot in Milwaukee. I drive at night and sometimes I would miss my turn. So, I go in the shoulder to find my way around. Why would it be my fault if someone slams in to me? Doesn't matter if you drive a four wheeler or s truck, still need to pay attention to the road.

    No Parking means no Stopping except in an emergency....then out come the triangles or flare...truck must use 4-way signal lights. It not a place to pee, trough out terds or read your map.....keep going to the next exit and pull over in safe place on the shoulder several feet from the roadway -----5 ft for placard loads.

    Failing to do so can result in a ticket and points on your CSA or worse some idiot slamming a 80,000 lb vehicle into you and breaking your neck.

    If the police determined he was legally parked, what does it matter what anyone else would or would not do? The guy probably feels horrible enough with a deceased human on his soul without all these fingers pointing at him.

    The video and the associated pictures are gruesome... I don't believe the driver of the rig will ever get over this one.

    You certainly would be considered to have "contributed to the crash," unless you are broken down to the point where you can't move. Primary fault? Of course not, but by the time the scum bags, er attorneys are done with you in court, you will feel like it was. And lawyers and juries go for deep pockets. In other words, you, your company, and the company's insurance company.
    Strongly suggest that you know where you are going, before you leave where you are.

    Um, that isn't the point here. Sure the guy probably feels like crap. But he should not have been stopped there, legal or not.
