Thaks DAC for reporting me as a FELON!!

    I got my DAC report/USIS 20-20.

    It states I had a second degree felony that was dropped to a third degree felony!

    Actually it was a third degree felony that was dropped to a misdemeanor.

    I called USASS.. I mean USIS and they told me they would look into it. First I have to fax in my license and social security card.

    No wonder some companies turned me down!

    Perhaps after it is corrected you can reapply at some of the places that turned you down and explain what happened. Just a thought. Good luck either way.

    It took USIS about 4 wks after mailing the requirements in to return the report along with an apology stating the long delay due to the large number of recent requests. This was a less than 2 wks ago.

    Didn't I read somwhere that OOIDA sued DAC for unfair
    practices and lost? If I remember that right they may
    be very interested in your case. If someone is telling
    companies that you are a convicted felon and you
    are not isn't that slander? You may have a chance
    to make some money and make things better for
    the rest of us at the same time.

    Slander is the spoken word that defames someone's character resulting in the loss of wages or income. Liable is the written word that defames someone's character resulting in the loss of wages or income. Either way you have to prove you lost wages and or income because of it. I'm not a lawyer or smarty-pants...I just researched it once is all. It sounds like you may have a case. But I'll bet a Lawyer will tell you to give them ample opportunity to correct the mistake. Maybe not if you've already lost wages from this error. However, if they do sue them, make sure you've kept all written records of and and all your correspondence.


    I still think drivers need a national False Reports Removal Fund for just this sort of thing. Just incase you have to take em to court.

    Several months ago I discovered that Michigan reported that I had 4 tickets from a Court in Arizona for "open container". Arizona DENIED that I had SUCH tickets, and denied I had any record of getting any tickets at all, what-so-ever. (I have a CERTIFIED copy of my MVR from Arizona to PROVE this) This "Court" denied ever releasing such information to Michigan or anyone else.
    Two weeks ago I pulled my DAC, and DAC reports state that I got a ticket for "consumption of intoxicating beverage with-in 4 hours" of being on duty.
    Allegedly ALSO reported by the State of Arizona.
    Not only have I NEVER gotten any tickets like this in Arizona, but I have NEVER gotten such tickets from any other State....EVER!
    I am sending out on Monday, via certified mail; a request that USIS/DAC remove these errors from my reports with-in 30 days and provide me PROOF that these innaccuracies were corrected. I ALSO have been denied employment by at least two employers, who claimed they didn't use DAC (but DAC Reports say otherwise).

    I am wondering if I might have a claim against the COURT that published these errors (to Michigan and USIS/DAC)

    don't feel bad lugnut i am in the same position as you are, i started a small post a few weeks back about wrongful reports on the DAC. i'm currently running a class b truck . but in time i would like to return OTR.unfortunately in my case it will be a little difficult thanks to that lovely DAC report my last company submitted to

    I had the same problem with NJ and still do. Not with just DAC, but with the Georgia State Patrol. I was released from Orientation cause my CDL was pulled due to a DUI in NJ. I had proof I was no where around NJ when the DUI took place. Good ole Log books. It was a guy same name, 1 months difference in birthdates. Took an act of the Georgia State Congress to get my CDL's back.
