You guys are blaming DAC/USIS for having this on your record, where do you think they get their information? When a company orders your Motor Vehicle Record (MVR) thru DAC, DAC will send in a request for it to the state that you have your CDL thru and that state in return sends the MVR to DAC and then DAC faxes it to your company. DAC/USIS is just the mail carrier. I don't think DAC adds tickets to your record.
Same way with your criminal record, DAC/USIS gets this from diffrent states, they run your information through and the states will send them info on you if you have ever been convicted of a crime. So if the state made a mistake and put felony on your record you need to get with the attorney that handle your criminal case and see if he can fix it.
Yes OOIDA tried to sue DAC/USIS and lost. I have said this before, DAC/USIS gets there information on your employment history from the company you worked for, what ever the company says goes on your DAC report. If it is wrong then go get an attorney, pay him $25 to $50 depending on the attorney and have him send a letter to your previous employer telling them to change their report on you in their file and on DAC or you will seek legal action.
If OOIDA was using their head they would have gone after the company that reported the negative information. But OOIDA thought they could just kill the messenger then their would not be no more DAC and that did not work.
90% of the time the drivers that complain about DAC are the ones that quit under a load, abonden a truck, do drugs or keep wrecking or damaging their trucks. Then you have the ones that get made because they filled out an application somewhere and left off one or two or three companys because they are hiding something and the company finds them on DAC when they run it.
USIS/ DAC is not the only company out their that does reporting but is the most common one used.

Just remember that DAC has to follow the same rules and a credit reporting agency. They are covered under the Fair Credit Reporting Act. This shields them from action in many cases, since they can hide behind the excuse of "We only reported what we were given".
If the reporting agencies have shown that you do not have the record that DAC shows, then you can go after them, but you have to first rebut the allegation, send them a certified copy of your record, etc. by Registered Mail, return receipt requested. This CANNOT be dealt with over the phone. It would also be a good idea to pay $100 or so to have an attorney follow it up with a letter threatening legal action, once the receipt for the registered mail has been returned to you.
You also have a right under the Fair Credit Reporting Act to have a note disputing any false or incorrect information attached to the DAC file.
I had the same type of problem when Dick Simon reported that I had refused/failed a drug test. The only problem with that information is that I had quit Simon the day before they wanted the drug screen and was sitting in Orientation at my new employer, 650 miles away... -

If you do a good job, do it safely, protect your CDL, take you truck back to the company when you quit, do not quit under a load, deliver your loads on time, don't tear up the equipment, clean your trash out of the truck when you get out of it, don't steal, don't do drugs, don't drink and drive and don't have alcohol in the truck, don't be a job jumper and don't ***** about everything to the company just because #####ing is what you do best.
These are some of the things that you see on DAC and I have been on both of sides of the fence first as a company driver, owner operator then I went into the office as a terminal manager then safety director and back as a owner operator. I have seen it all over the years, their is some #### good drivers out their, and then you have the 20% that gives the industry a bad name and those are the ones that worry about what is on the DAC report. It is pretty funny when you have drivers call up and ask for a job and then ask you if you run DAC and when you say yes they hang up.
I had a guy apply one time and he had 26 jobs in the last 10 years, he averaged 3 months a job and yes I turned him down. I left the office because I just got tired of dealing with those 20% in this industry. Out here on the road I can just shut the CB off if I don't want to listen to it, in the office I could'nt do that. -
