    OK, got that much.

OK, that makes sense so far.
OK, the first question I have is who gave him the keys to the truck?
    Not the insurance company's problem.
    Not the driver's problem.
Wait, here is where it gets cloudy, did the owner not add the driver to the insurance, right?

    That's what you said, right?

    So it isn't the agent.
That's all, the last time we had to deal with county road commission bill, it was 11 times as much.
So you have an arm chair owner, needs to sell his trucks and focus on a franchise or something.
No acceptable and it is a lame excuse. On-boarding a driver isn't something that is done in one day, there are steps and it sounds like this is an unethical 1099 scam.

    Are you in Russia?

Here is my opinion - The owner needs to deal with the bill, there is nothing that can be done to the driver. The driver wasn't allowed to even get into the truck until the legal process was followed. Many cheap owners will hire a driver and cheat the system, it sounds like this is the case. The insurance company should drop this carrier for fraud, there is a serious problem with handing the keys to any person who is unauthorized to drive the truck, and the person who gave them the keys, need to be fired.

Another old timer said "A company gets the kind of drivers it deserves." Gotta agree.

Allowing an unqualified driver to drive can get a DOT number revoked by FMCSA...this sounds like somebody that has absolutely no clue about what they are doing. Trucking is not simple and has a lot of moving parts...being out of compliance is expensive!

double or nothing the answer he is looking for is “hold the drivers last check and make him pay for the damages”

Naa, sounds to me like the driver pulled out of the parking lot without cranking up the landing gear or took out a signal going around the first corner. That guy didnt get 2 miles out of the yard and doesnt have enough on his check to cover the damages and crybaby owner (the OP) wants to know if he can sue the driver.

To wit I will say you can sue anyone for anything.

Will you win? Not a chance. But yes, you can sue him...

My guess this guy is one of them 1099s out of Chicago. You know, the guys that speak this: Просто интересно, что за повреждение дороги и сколько денег? Не совсем относится к вопросу, но мне любопытно
