    Yes, that's what I did. I sent the adjuster copies of the SMS in which I asked the agent to add the driver to the insurance. At least the insurance company paid insurance for the cargo but increased our monthly insurance payments. I probably won’t go to a lawyer. Of course I have learn how to put a driver in a truck Thank you all for your friendly advices.

    how is showing “how easy it is to make a mistake” have anything to do with the situation?

    You asked a question.

    who is responsible? The owner, driver or insurance company.

    Given the facts and lack of experience, we gave you an answer.

    so what does showing how easy it is to make a mistake change the fact on who’s responsible?

    Those in the photographs had no conscience and they calmly took 100,000 from the insurance company and wanted to get more from us. Fortunately In our case, no one was hurt except us and the road.

    But some of the answers seemed to me to be overly critical. “It's only those who do nothing that make no mistakes, I suppose.” But here they explained to me the principle that before entering the water you need to find out where the ford is.

    A few years ago one of our guys left the yard with a wheel frozen. I was stopped at the cross street and saw/heard the tires being destroyed and blared the air horn at him as he passed. I caught up to him at the next light (half mile away) and ran up the side hollering and hitting the trailer to get his attention before he started moving. The 'driver' hadn't seen, smelled, heard, or felt the tires blow. I got the brakes released and then led him back to the yard where he could get road repair out to change the tires. He complained to Ops that I was "mean and disrespectful; sure, he made a mistake but there was no reason to treat him that way". My response was "he cost the company over $1,000 due to pure stupidity. Does he want me to say it's no big deal and give him a lollypop?"

    You've gotten some tough love but no one has been overly critical. I think the responses you've gotten have been very reserved in their judgement. Heck, the mods haven't had to step in yet to remove any personal insults.

    Count yourself lucky that you got out of this reckless bet as cheap as you did.

    the guys and gals here will help you if they can in real life and many here can stand witness to that. I myself is one who has been helped by many here. One thing they won’t do and that is to sugar coat anything. We speak our minds and feelings don’t have a place in trucking.

    Sorry Dude, I don't get what this is all about.

    I mean that you come here, act like this is a problem you have and seem to look for sympathy but it seems you do not understand what's the real problem.

    I am going to assume that you are working with one or a few trucks, just put an ad anywhere and hire drivers because they have a CDL to make money. You are running on thin margins with little or no reserve at the same time paying yourself first and paying the driver as a 1099 contractor - how far off am I?

    If you are the owner, then take this advice seriously, you need to either sell the trucks or park them until you learn how to find a driver, learn how to follow the regulations, and have a reserve to both pay the driver and pay for these problems when they arise. $4300 is nothing, if this breaks a fleet owner, then the fleet owner needs to sell out and go buy a subway franchise.
