The legisics of a not for hire company

    Our company has 5 semis that say on the door not for hire.we only haul the product (cardboard)that we sell to our customers.now we've expanded the business to include hauling a so called back haul from our customers to their customer.their products in our box's now.the question is now we are a not for hire company.we are getting paid for this haul by the company thats ending up with their product in our boxs.is this legal in the not for hire satus.the company I'm working for said it's legal due to the fact that the product is in our box's.someone help me here with the logistics of this.also this company is going to separate the transportation part of the company into it's on supply chain logistics company.if that matters.

    my opinion is, since the company is getting paid, then they are for hire. I have never heard of the packaging making a difference as to who owns the product inside the packaging... idk maybe a more knowledgeable person will chime in here.

    By hauling goods for other companies, you are a common carrier, and all regulations apply. You have to change your MCS 150 and you have to carry all required insurances (particularly cargo insurance and minimum legal liability).

    That's going to be considered for hire by every DOT officer I've ever heard of and I'm sure it is to the lawyers too

    You giving your company legal advice is not a good idea. I believe if there is a violation, it is on the company, not you. There Is a term called “trip lease”, that would enable a private fleet to lease a truck to another company, not sure if this is still being done, but done properly was totally legal. The company that was leasing the truck took all responsibility, and ran it, (didn’t matter who was paying the driver, as long as he had a good CDL, and medical card) as if they owned it. Same as any company could rent or lease from Hertz or Penske, and haul any product that they owned.

    I actually think that the “not for hire” on the door, was put there to prevent truck drivers from picking up some side business, that the boss didn’t know about, and was not getting paid for. So if a shipper saw that on the door, he might not put his freight on that truck, realizing that the driver did not have permission to haul it.

    You go looking for trouble with the way your employer runs their business, you just might find yourself out of a job. But then you could sign up for law school. Always a positive ending.
