You didn't read the entire sentence Probation BEFORE judgement there fore their was no judgement and I had copies of the law as well as an explanation from my attorney, anyways it didn't help any! I have had it expunged but still need to explain to people because of what happened at Werner.

Here's the best I can do for you: In law - what you see . . . is seldom what you get. If you're going to fall for reading statements literally without further investigation then you'll always wind up on the short end of the stick.
I've adjudicated five cases at the state level by myself and won all five. So my record speaks for itself. When you win six cases in a row, feel free to contradict me.
In the meantime, look up "probation." Investigate that word, it's obvious you haven't.
On second thought - if you were really conscientious, you would have looked it up already.

A sentence whereby a convict is released from confinement but is still under court supervision; a testing or a trial period. Probation can be given in lieu of a prison term or can suspend a prison sentence if the convict has consistently demonstrated good behavior.

You fell for their scam and in your ignorance of the law and trusting your attorney - you voluntarily allowed yourself to be SENTENCED. And now you're guilty.
In your case, the word "judgment" refers to the legal process that you avoided: A bench or jury trial that would have resulted in A VERDICT.
You avoided a verdict in favor of volunteering to be sentenced. (Be sure to thank your lawyer for that piece of advice).
They have a motto in law: Ignorantia juris non excusat
Ignorance of the law is no excuse
AND THEY MEAN IT!

In the State of Missouri we have what is called SIS [FONT=arial, sans-serif](Suspended Imposition of Sentence), this would be the same thing as what Mack Attack is referring to Maryland having as a Probation before Judgement. Neither is considered a Conviction and should not be reported as one. [/FONT]
[FONT=arial, sans-serif]In Missouri if you complete your probation on a SIS you will not have a record and at no time were your rights taken away from you. Although as part of a SIS you are not allowed to carry a firearm. The next step is a SES which is a Suspended Execution of Sentence, I do not know what Maryland would have. A SES in Missouri is a conviction you just avoid going to prison and your probation starts all over again. Parole is different from Probation as it means you have been to prison and it cannot be restarted.[/FONT]
[FONT=arial, sans-serif]What all this means is, say you get charged with a small felony, such as my crime of missing a couple of child support payments, you plead guilty because you only own a small amount and they are giving you a SIS. You are put on 5 years probation with a [/FONT]
[FONT=arial, sans-serif]four year "Backup". That means you have to be a good boy for 5 years. If not, off you go to prison for 4 years. Lets say you were pretty good but get a speeding ticket one day before your 5 years is up. You get called in to see the judge and he finds you violated the SIS. He gives you a SES and your 5 years starts all over again. But now you are a convicted felon. You can't own a gun, your right to vote can be taken away. And forget about working in many different jobs. So, you put up with seeing the probation officer for another 5 years and then another traffic ticket. This time the judge sends you to prison. For 4 years. However it is your first felony so you only do 15% which is a little over 7 months. They mess with you for 14 years over nothing. That is why a lot of men just say send me to prison. They save 10 years of humiliation.

Wooly, this is where I got in trouble, I pleaded guilty to get a lesser sentence, by doing that it wasn't considered a conviction by MD law, but by pleading guilty it was considered a conviction by dot rules, which I didn't know at the time, so I told Werner never been convicted, so they say I lied on job app. I have been paying for it ever since. I was on unsupervised probation for 1 yr. after that year I was finished my time with the state of MD. Being it was only a misdemeanor charge I could have the charge expunged after 3 yrs, which I did. But here's the fun part when filling out job apps do I tell them of the charge? Then I have to explain why Werner let me go. Of course I could tell them I was laid off, that's what Werner told the State of MD when I applied for unemployment( the first time in my life). Well anyway time to get back to trucking as wwest says!
