Don't hold your breath on the feds legalizing it. If they wanted to legalize it they would've done it when Obama was President and the Democrats held the majority in both the House and Senate.
But even if they do, nothing will change for us unless the feds also change the regulations that make it illegal for us, and the insurance companies change their requirements. -
I personally oppose the federal ban on marijuana on 10th Amendment grounds.

As do I. In fact, I wish the establishment and the courts were as infatuated with the 10th as they are with the interstate commerce clause and the equal protection clause.

The orginal DOT drug testing program was pilot tested that way prior to the Ominbus Act of 1991 and challenged on the basis of constitutionality. They settled on the random urine screening that has been in place since 1993-96 (depending on employee count) as an alternate.
The current system does leave much to be desired, especially around owner operator random tests, but I don't think going back to random roadside tests is a step in the right direction. I see it fraught with potential abuse. Having disinterested third party collectors leaves little temptation to fudge the test for a specific result compared to the officer trying to nail you for something.RockinChair and Concorde Thank this. -

I’ve always felt that if truck drivers were subject to random drug test, and forced to pee on command or now give hair or saliva, then shouldn’t all drivers be subject to the same?
If this is all in the name of safety, well I could be on a vehicle as small as a motorcycle and cause a deadly accident just like large trucks can. And most accidents involving large trucks and four wheelers are not the fault of the commercial driver.
