They need to mandate hourly w/ OT after 40

    No truck driver was deceived into getting CPM pay for truck driving. Each driver either didn't bother to ask how he was getting paid, didn't care, or accepted CPM. Certainly after the second paycheck he could have the info he needed to accept or reject CPM

    You are exactly right. I worked hourly for 18 years. It didn't cause me to stop caring what time I finished work or dance around the truck while customers delayed doing their job.

    The trucking exemption for some jobs in trucking was in place because not having it can lead to safety sensitive jobs being rushed to be completed in order to not incur OT costs. That was the argument made at the time of the FLSA and you've spent how many decades always asking for an answer but never looking for an answer? Which part of NY are you from, being an expert in everybody's business?

    What if some guy on the internet convinced the govt to outlaw unions, or outlaw hourly pay? The person that accepts the job is in the best position to decide if the pay and conditions are suitable to him. "Wait, you can't take that job I don't think it pays you enough, or the right way."

    What you're describing is free market thinking. Some don't like that theory. Usually those that can't seem to figure out how to tie their shoelaces, can't give directions to wherever they work, and have never really made it anywhere in life, so they believe the government should step in and take care of their 'problems'.

    Right. And it’s up to the employees to choose the best place for them to work. If the exemption goes away then the market will naturally dictate what direction things will go all without a government mandate that will naturally become the lowest common denominator. If someone doesn’t agree with how or what they are paid then they are free to move on and better their life. Somehow I’ve managed to survive nearly 26 years in this industry making what I consider a fair wage when I was a company driver all without 50 page pay structures. Just because some companies make it difficult it doesn’t mean the government needs to come in and hold hands.

    And your last sentence about lease operators, that’s also something they entered into under their own free will. The government can’t protect everyone from themselves no matter how bad you’d like them to control everything.

    But that is why we have our 70 hour rule. So what is the excuse now? Even now they can just toss that out the door when they (government) needs people to work more from disasters. Seems when that happens and people work more they do not have anymore wrecks or killed drivers. I am all for government to kick rocks but it should be fair across all platforms to me. Either let all companies across all platforms pick a pay form or make everyone go by all the rules everyone else goes by.

    And to be fair none of this matters to me because I am O/O and will never work for a trucking company. I have always seen the truck industry pay scale a joke.

    No OT i refuse to work…I average 35 hours weekly (1800 miles) line haul. Most us old coots don’t want 70 hours and sure as heck not without OT…thats for suckers just giving away their time​

    Repealing the exemption wouldn’t affect owner operators, but if the government steps in and says trucking is now hourly pay and the minimum is $30 an hour then everyone who’s been paying themselves a “reasonable wage” from their corporation now has to pay themselves $30 an hour plus OT.
