Just my point out of the HAM bands is not my problem the owership of EXPORTS is not illegal the use is .... ONCE it has left the dealer and they have warned the buyer the FCC has no say UNTIL they get caught using it.
Until the EXPORTS come set up so that if you put it on CB it can't go on the ham bands the debate will go on .....

Gadfly...Did you even read the article you copied and pasted about the Pilot?
First...They did not pay a Fine..."They made a "voluntary contribution of $90,000 to the US Treasury"....
In other words, they didn't fight the complaint filed by the FCC.
And according to that report, it looks like the main problem was they were marketing the radios as multi-band CB's and not 10 meter radios. (which is a No-No.)
Had they just sold them as Export Radios, and not CB Radios, their wouldn't have been a problem.
Even tho apparently some of the employees were also calling them CB's, but they could have beat that in Court if they had persuade it...
Plus, this was back in 2006...Since that time FCC has lost so many cases trying to take these shops to Court over the Export radios, unless the shop is advertising the radios as Muli-Band CB sets, it doesn't even raise a flag on their site anymore...
About the only thing you can find on the FCC Web page anymore related to CB, is guys with Base Stations running mega-watts and messing up neighbors TV's and phone systems...Not necessarily Export radios, unless they have a Amp hooked to it...It's usually the Amps that cause the bleeding problem anyway. Not the radio...
And to say:
Granted there are probably a few who venture off onto the other Bands. But at the same time, their are plenty of Hams who have had their radios modified for 11 Meter's to, so they can talk on the CB Channels, and have the same attitude like your describing about CB'ers.
They think that since they are a licensed Ham operator, they can have a radio that can be used on the Ham Bands AND 11 Meter...regardless of what the FCC says...
So the "Myth" go's both ways.......

If these radios are fake 10 meter radios, why would they be a problem to you as a HAM operator or the FCC? A fake radio doesn't actually work, right? How could it transmit on 10 meter? Is the 10 meter band just a fake band?

No they work but
are not useful.
Many are AM/FM and cover only to 28.800 or even less and there is NO AM/FM on 28.000- 28.800 AM begins about 29.000 and ends about 29.200 MHZ. FM starts on 29.500 and goes to 29.700 with simplex on 29.600.
TO my thinking if the makers of the sets had set them up so that if you expand them to cover the freebands they would NOT cover 10 meters even the FCC would not care ...... -
The ones I consider criminals, YES...............THESE are the ones who ignore rules, use power that is excessive, come onto frequencies and bands they have no business ON. These same people are the ones I would not want to deal with in business or personal affairs. They are JUST as untrustworthy as they are on a radio because their ethics are screwed up! IF they "only" want the power of an export, THEN WHY DO I FIND THEM UP THERE? HUH? If they don't want "extra" channels, then why do I have to put up with them on MY licensed frequencies? WHY can I not USE what I tested on without bandits on 10 Meters? But yet........OH YEAH!!!!! I'm supposed to stand by, I'm supposed to wait for them and invite them right into my "house" and not say a word! How DARE anyone say anything about one's "sacred" cows!!!!
Now lets put the shoe on the other foot. I almost NEVER talk on 11M. When I DO, it is on a LEGAL, 4 watt, 40 channel CB radio, and it is used for traveling. I turn it on, LISTEN when there is a backup (I even have ONLY a window mount because I don't CARE about talking bookoo's of miles!!) When I find out which lane to get into, I turn it OFF. I NEVER interfere with CBers. I never "chat" on 11M. EVER! Yet when the band is good (10M) I can turn across 10 and find CBers complete with the "cutesy" lingo from 28.035 all the way up into 28.300 and beyond. Now WHY is that? Is this caused by "CBers" NO! Is it because of people who buy these illegal radios (illegal to use on CB or on any band without license), succumb to the myth of a "freeband", or 'extra' channels that is there for the taking?
Is it because these people CHOOSE to break the law? Which IS it? It has nothing to do with legal CBers who stay between 1 and 40. What, then, should I CALL these people who show up where they don't belong? You tell ME!
*( AND, FINE, or "VOLUNTARY" contribution, it still amounts to the same thing. They got CAUGHT, they negotiated the amount down some, they PAID money + removed the fake "10 Meter" radios from their stores. It had the same effect!~) ALL I want is for the outlaws, bandits, "fine' upstanding people---whatEVER you want to call 'em, who have no business interfering with ME, is to stay OUT of the ham bands! That's all I have been saying forever.

I know allot of CB'ers who are also Ham's, and when on Ham channels, talk just about the same way they do on 11 Meter. Probably mostly out of habit. And they also don't use the Export Radios when on he Ham Bands. There's a Couple here in town that I know of has a room full of radios, and when skips rolling they will be on their Cobra 2000GTL talking on the CB Channels...But when they talk on the Ham Bands they have other radios...(No Exports)
Now, I have been over their house and listened to them talk to others on the Ham channels, and everyone (most everyone) I herd, talked more or less the same way they do on CB....Granted I'm not that familiar with Ham Bands, so I have no idea what Band they use, but from what I herd, it sounded just like people on some of the 11 Meter channels...Only without all the static...
I know your suppose to use your call sign on Ham bands every so often, but from what I herd, not everyone does that.
What I'm getting at, is maybe it's possible some of the guys your hearing are Ham's, but not going by the rules....
Anyway....It's not a perfect World, sometimes you just have to take the good with the bad and deal with it... -
How do I know they are CBers? OK, here goes. 1) They come into the CW portion of the band with AM phone mode, 2) AM is used on CERTAIN places in each band---usually on the UPPER end of each band, 3) Most of them have the over-modulated "CB-sounding" radios complete with beeps and squeaks that go along with that group, 4) hams are NOT permitted to operate VOICE modes PERIOD between 28.000 and 28.300; its digital modes ONLY, and, finally, 'How 'boucha Diamond T, we's southbound thar, mercy sakes, g'ord haid thar SQUEEEEEEEEEK!" Ham radios don't go "SQUEEEEEEEEEEK!"
They don't "echo" either!!!!

The thing about the hams, IF they read the rules they would KNOW they can't use voice on the lower end of 10M. I hear this all the time----mostly truckers.
Again, WHY is it "bad" for ME to be upset at a bunch of people who are obviously out of band and OFF 11 Meters, but it's OK for those same people to come UP onto 10M and interfere with me? Why SHOULDN'T I be angry at them? What if I came into your garden shed, sneaked your lawn mower out, mowed my grass and put it back? Did it HURT anything if I used it? What if you came out while I was across the street USING your mower and it was gone? Is that OK with you? Would you NOT report me to the cops for theft? Does my possessing your mower withOUT permission harm YOU? Sure it does! It DEPRIVES you of the use of your property, and the theft or usurping frequencies without permission prevents ME from using something that I have previously obtain permission to use. That's what laws are FOR. Shouldn't your lawnmower be AVAILABLE when you WANT it? Should it not BE in the shed against the time you want to use it? Then WHY shouldn't 10 Meters be available to the hams to use when they want to without interference from bandits and thieves. It's the same thing. -
Guess I'm going to have to start scanning all the 10 Meter Channels more often...Because I can't say I have ever herd what your describing on 10 Meter...With maybe the exception of the Free-Band channels 40 above and below 11 Meter...
I have herd lot's of chatter on other frequency's out of Mexico that I'm sure are CB'ers, because of the Roger Beep's that they like using...Try turning those people in to the FCC...Last edited: Oct 5, 2010

Then I can take my 10 Meter Export radio...Hook-up 50,000 watt's worth of Power, aim my 8 Element Beam to the north and trash everything 28.000mhz and above with Rap Music...
