Told by DOT that I'm supposed to be on-duty at dock EVEN IN SLEEPER

    This was at the WB I-80 Utah POE. He said whether or not you're in the driver seat or sleeper you have to be on-duty. He pointed out the FMCSA rule that says "Attending to a CMV that is being loaded or unloaded". This is the first time I've ever had a DOT officer say anything.

    I just spent 6 hours getting loaded recently. That's a lot of drive time that's being taken out of my 70, not to mention my 14 hour clock won't be stopping so it means I might have to scramble to look for parking.

    He was nice enough to not give me any violations or warnings. It was more of a educating a driver about the HOS, but if I go through there again and I get called in I'll probably get a violation.

    I guess the officer and I have a different opinion of what “attending to” means. If you’re on the dock counting freight, sure that’s on duty. If you drop the trailer in the door and bobtail to get some food, would the officer still consider that on duty as well?

    Utah POE is full of crap. Sleeper berth is sleeper berth.
    Ignore the POE and keep logging as you have been in the past.

    The regulation is what matters, not necessarily the opinion of the DOT officer or a trainer or company policy. DOT officers are wrong on occasion.

    Look up FMCSA On-Duty time definition.

    I know my company policy was on the back cover of our logbook (tells you how long ago) and it listed when we were released from duty..

    I go on duty 10-15 minutes with a note..At pickup..At delivery. Never had anyone question it.
    Imo that officer is wrong. Once I’m locked to a door and not allowed on the dock I’m relieved of duty to it. Some deliveries an picks I have to drop and go to the bobtail parking and wait. Can’t tell me I have any duty to the trailer.

    Maybe if I pulled a flatbed I could see being on duty more than 15 minutes.

    Sometimes I just want to use duty status with a note..Off duty for a 10-200 :)

    Question , im at the dock they say 4hrs till unload , can one hop on their bike and hit the slop shop i saw coming in ? or can you not leave the truck unattended?
