Told by DOT that I'm supposed to be on-duty at dock EVEN IN SLEEPER

    Why or how would they know that, Yesterday I ran out of hours when I was going thru Lost Hill, Pilot. Parked by the curb on the entrance and went straight tot he sleeper for 5 hours ( half of my split, but what I needed to get home legally). Never got out of the truck, park, sleeper for 5 hours and left for home never going off duty, just to driving. So how would ":they know anything unless I told them something different". Got home in 3 hours, did a 15 minute post trip per company regulations, turned the truck off and came into the house.

    The lesson keep your mouth shut, the only reason a cop talks to you is to get you to say something they can write you for. Give them what you are legally required, License, Med if ask for, elogs if ask for , BOL's if ask for. Do not volunteer anything.

    Sleeper was 10 hours straight. Not 5 and walk home.

    Logging straight sleeper over and over is falsified no matter where you're at.

    So according to you you cannot split sleeper berth., well your definitely wrong on that, just the two have to add up to 10 hours, 7+3 8+2 5+5 6+4 and so on. Completely legal, not even questionable, it is the only time I log sleeper is when I know I'am going to need to split, use it a lot when doing multi pick produce loads.

    5+5 and 6+4 are not legal split breaks. A split sleeper break is one period of at least 2 hours off duty or sleeper and one period of at least 7 hours in the sleeper. The two rest breaks must add up to no less than 10 hours.

    You can do the 5 hour break if you want because it is more than 2 hours but you still need another 7 hour sleeper break at that point to get a full split break.

    49 CFR 395.1(g)(1)(ii)

    (ii) Sleeper berth. A driver may accumulate the equivalent of at least 10 consecutive hours off-duty by taking not more than two periods of either sleeper berth time or a combination of off-duty time and sleeper berth time if:

    (A) Neither rest period is shorter than 2 consecutive hours;

    (B) One rest period is at least 7 consecutive hours in the sleeper berth;

    (C) The total of the two periods is at least 10 hours; and

    (D) Driving time in the period immediately before and after each rest period, when added together:

    (1) Does not exceed 11 hours under § 395.3(a)(3); and

    (2) Does not violate the 14-hour duty-period limit under § 395.3(a)(2).

    Take it up with CHP, I really don't care been logging it that way for years and never ever had a problem.

    That was what I was doing. Has nothing to do with anyone or anything else.

    So no. I'm not wrong. And I'll listen to the actual conversation of a cop over some dude on the internet.

    Correction to my statement earlier, 3+7 is legal so is 2+8, my mistake on the less than 7 in the sleeper, that is proposed but not passed as yet. However I do not change my stance on incriminating your self by talking to the Police, your log enter should be clear enough to speak for it self. I have not had any problems with the way I log, For instance I got home Saturday Late, went off duty and have been that way, I will not show any sleeper, as that is none of there business. My truck will have been parked for over 34 hours, off duty.

    People run their mouth and tell those cops too much, that's none of their business. If they ask, what were you doing? Just say, you were in the sleeper then they came and told you to move. Or just shut the gell up, stare at the sun and say nothing.

    Make your logs realistic and your mouth won't need to stay shut.

    In other words. Don't give them a reason to ask questions.
