Made whole was from the controller at one company talking to a retired couple who's retirement RV was just smacked by our truck, they were stopped in traffic on the Interstate where the backup extended beyond the signs warning about mowers. Log truck rear ended our empty tanker at speed and he clipped the van before leaving the highway plunging down into a swamp where, after the sudden stop, the interior cabinets and his gear did a Mile Tyson on him as it exited through the windshield...
6 months later at the annual safety meeting I asked if he was wearing his seat-belt.
50 gregarious truckers and the office staff go real quiet when he said if he wasn't he would have been run over by his own truck.....I expected he was but didn't know and I consider it to be the best safety meeting I ever conducted.
It was a new tanker one of our first built after they introduced the stronger under-ride regs. Barrel was OK, rear wrapper buggerd a bit and the entire under frame and suspension was replaced with new under ride stuff. ran about 25 grand.Vampire Thanks this. -
Figure out a dollar amount that would make you “Whole”and see what the tow company’s insurance offers.
Not just your equipment cost but your daily lost revenue also..
Be realistic with your settlement price.
Once you have an offer in writing, I’d consult a lawyer before signing and accepting.

I used to be in the towing business. By law, a towing business is a trucking company, and has to have a US-DOT number, and the same insurance as a trucking company (plus on-hook coverage which covers towed vehicles). That doesn't mean that they do. I suggest looking them up to find out IF they have a US-DOT number, from there you can tell IF their insurance is active or not. And unless your insurance company is supplying an attorney, you need one. Someone who goes into court without an attorney is a fool. And also just lost the case.
