    Explain this?

What do you mean they pulled from your account?? As in you have dozens of loads sitting with them in payables? OR
If you were that foolish to give them a bank routing/account number...Well, Lesson Learned

They direct deposit our pay, they don't mail checks anymore all digital, no other way to get paid on them.

who told you that?? Its Illegal to demand routing number and account numbers-- EVERYONE will mail a check-

If your in Business..........YOU NEVER give a outside establishment your banking info- Especially a broker

See....They make an option for direct depositing and look, Who Got Burned? Certainly not them

I don't want to pour salt in the wound but man- Please....Look at this as a learning experience.

So you signed something authorizing them to make withdrawals? I thought, they only could withdraw the amount of what was deposited there by them by error but not an amount of a disputed claim. I would file a claim with your bank against them for a fraudulent withdrawal. Most banks should guarantee protection from unauthorized withdrawals and not only that, they (the bank) should give you conditionally the money back until the dispute has been resolved.

I agree it was wrong. But, if this happened in March and you were still doing business with them in November that is your bad. After all the info posted on them I can't feel sorry for Anyone who gets burned by them. It is not if you get burned it is when. The big companies will not haul their loads they know better. They prey on newcomers and small companies.

    Rant over.

I think I read on here somewhere that they have it in their contract that they can withdraw from your account. No Way I would sign that. I am like you, not giving any broker my business account number. that's just me. Old School I guess !!!

And yet there's 1,000's of folks out there dialing their number like a radio call in contest to get them some more. And a revolving door of even more to take @KoonTrucking place. As a rookie everyone reads these stories and thinks I'm smarter than that, it won't happen to me.

In other words @KoonTrucking, your story is interesting, and I'm sorry to hear of your claim and hope you find better customers to do business with. Unfortunately, your TQL story will likely be ignored like the other couple thousand stories out there just like it.

You should probably seek legal advice. Google Hank Seaton. He is an industry leader in cases like this. His website has a ton of good (free) information if you're inclined to go read some. Although that legal consult will likely exceed the cost of the claim in the first place, which is what TQL is probably expecting. And you'll pay the attorney another big stack of money to hear what you already know. So read your contract fine print and find the arbitration clause, and anything regarding claims and disputes. Then follow it. That would be your only hope of clawing back that claim on the premise of shipper load and count. Don't think you can just sue in small claims. If there's an arbitration process you agreed to, the judge will throw your case out.

Amen. To be fair, his claim didn't even break wind until September. Probably on day 179 of a 180 day limit on claims in the contract. In the mean time, he probably got paid and had forgotten about the whole thing. Then it festered through the cargo claim that got denied, and some big brain at TQL just took the money.

Unfortunately @TallJoe, I doubt the bank can do anything. If they investigate, TQL will just present the approval document and get away with it.

I kind of like the fact that blizzards, floods, and other acts of nature rarely interfere with ACH or wire transfers.

The answer to this problem is easy. Open a second checking account for receiving ACH payments. If you're super paranoid, open it with a separate bank. If you're with Wells Fargo like me, you probably have a dozen checking accounts already open you didn't know about LOL. Just kidding about that last part, but yes I do take ACH payments through a clearance account. Once the payment posts, the money gets swept right out, never to be seen in there again.
