Traffic school with a commercial license!??

    So i got pulled over in my personal use vehicle (aka a four wheeler) for doing 81 in a 65mph zone. The cop takes my license and asks me why i have a CDL A. I told him i used to drive trucks, long story. Anyway, he returns to my vehicle to inform me hes going to "cut me a break." Instead of citing me for the 15+, hes knocking it down to 75 in a 65 and supposedly significantly reducing the fine AND making me eligible for traffic school. Wha-wha-what?? I told the officer, no you must be mistaken. I have a cdl and therefore I cannot attend traffic school. He insists no I can indeed attend because of the way he's writing the ticket??? I investigate the ticket further and see that the boxes for commerical license and commerical vehicle infraction are both checked "NO." Did I get hustled, or did I really catch a break?? Because as far as I know there is no option to attend level II traffic school when you possess a CDL in California, and the fines are higher in amount whether you're in a commerical vehicle or not...

    u used to have that option, but i thought it had been done away with for CDL holders...but could be wrong. havent had a ticket in a while

    Show up at the traffic school anyway. He still gave you a break by reducing the ticket to 10 over.

    the cop gave you a break. but who knows what happens when you get to court. they may pull up your record to see if you have any priors. to which the record will probably list you as commercial.

    all you can do is cross your fingers.

    in utah. there's no school for commercial.

    You need to go to traffic school so grab onto the opportunity. :)

    FYI, at the officers discretion 15 over you can be charged with reckless driving which can be an arrestable offense if the officer so chooses. So count your blessings. If you ever plan to drive a truck again respect that CDL.

    Legislative Update- Governor Signs CTA-Sponsored AB 1888

    Today, Governor Brown announced that he signed AB 1888 by Assembly Member Mike Gatto that will allow drivers with a commercial drivers license (CDL) to attend traffic school for minor violations in their personal vehicles, just as any other driver on the road would be able to do.
    AB 1888 restores the right of CDL-holders to go to traffic school to have the points held back from hitting their license and putting them at greater risk of losing their license. CTA members asked the question, “Why should a driver be prohibited from going to traffic school for a minor violation that involved their personal car simply because they have a CDL?”
    The California Trucking Association, California Teamsters Public Affairs Committee and a number of other business groups supported this new law because it ended discrimination against CDL-holders for the time they are not exercising the professional aspects of their license and helped maintain a qualified pool of professional drivers as the industry faces a shortage.
    In accordance with federal law, this new law will still require disclosure of the violation to the Federal Motor Carrier Safety Administration (FMCSA) for CSA purposes, but the point will not accrue to a driver’s license. While CDL’s are issued by states, the regulations governing state CDL programs are administered by the Federal Motor Carrier Safety Administration (FMCSA).
    The law goes into effect January 1, 2013 and the Department of Motor Vehicles (DMV) will begin working on implementation of the new law as it does require some programming work on their end.
    CTA undertook this effort back in November 2011 at the direction of the Board of Directors following a motion by the Safety, Security and Human Resources Committee.

    So looking at that, you can work your way out of the State license points, but still get in trouble with the CSA points!

    brand new law, that makes sense. f#%k the csa. i prefer not to live in poverty and don't see myself returning otr anytime... all i'm concerned with is my state license...
