Three years ago when I left the field of Nursing to become a truck driver, I went to USA Truck Driving School and was pre-hired for Swift. After 30 days in school and roughly 4 hours of driving straight down highways and neighborhoods, I got my CDL and went to Swifts Training Program.
I was assigned a driver trainer, who in no time at all scared the beejesus out of me. He never slept more that an hour at a time....NEVER!! I am sure he was paranoid about training a new driver, I would have been for sure, but to never get a good nites sleep was beyond me. After a week of this, I confronted him and asked if he was comfortable with my driving, to which he replied, "yes". So, I asked him, Why don't you ever sleep?, don't you think sleep deprivation is dangerous?, to which he replied, "i don't think youre qualified to discuss any medical issues with me. I reminded him that I was and still am a RN with over 25 years of experience in Medicine. With that, he got out of the truck, made a phone call and I was shipped off to another trainer.
My new trainer had more sense then the first one but barely. After three days with him, I was worn out. He would run continuously, and while I tried to sleep in the bunk, it was impossible as the truck bounced down the highway. On the third day, he woke me up after, I had two hours sleep, from a 12 hour day of driving, and wanted me to practice backing up at 3am, and in a truck stop that was over-crowded. Needless to say, I backed right into another Swift truck...
When I got back to Denver, Swift fired me and put this "accident" on my DAC and I am a do not re-hire. I fall to see how while in "training", this is allowed to go on my DAC. I have written to DAC and explained the situation, yet they refuse to remove this negative statement from my records.

He knew you had little sleep but pushed you to back anyway? How was he at backing? Almost sounds like he didnt want to so he got you to.
If it were me, I wouldnt have done it. If there was any static, Id make a quick call to the company and let them know what happened and why I refused. I can practice backing all day long after Ive had some sleep. 2 hours isnt sleep, its a nap. :biggrin_25523:

You Should See About Getting An Attorney, and The Possibility Of Going After Swift For Defamation Of Character, companies Also Have To Be Careful What They Say. And This Dac Report Stuff Is Nuts,i'm Trying To Find Out Now About Mine, It Should Be Clean But Who Knows. I Guess Its Gonna Take Several People With Untrue Things On There Report To Do A Class Action Against Dac. Or A Disgruntled Postal Worker. Anyway Good Luck In Future Job Search, and Remember You Can Leave A Rebuttal Of The Dac With Your Application. And When Talking To A Recruiter Ask As Many Questins As You Can Think Of About The Job, A Good Recruiter Will Like That.

Sorry to hear this. My husband is having a problem with a bad report on his DAC as well by TMC. He applied there, was approved (so we thought) and was sent up there for orientation. He was then sent home in two days with them saying there was a mistake, they couldn't accept him. They then called him back to discuss the situation, and said, well, we can hire you. By that time, he had taken a local job and turned down their offer... now his DAC says that he was fired by them.. and now 3 years later wanting to go back OTR, he has been turned down by a company (Maverick) because of this. (We didn't know this was on his DAC until Maverick turned him down) they told him this was on there and the reason they couldn't hire him was because of bad references on his DAC... well, he's never had a bad reference, and he has called his past employers, and they say they haven't given him a bad reference, so we are trying to get a copy of the reports provided to Maverick and a copy of his DAC. Right now, Maverick (or the recruiter really) is giving him a hard time saying he can't supply that information, but I informed them that they are required to by law. So, once we get this all figured out, it's time to go through the process of rebuttels and such. It's a pain in the butt I tell ya. Especially when he needs a new job like yesterday.

Thanks to all of you for your replies. You can request a copy of your DAC by writing to USIS Commercial Services Inc, 4500 South 129th Avenue, Suite 200, Tulsa, OK 74134-5885; or visit (www.usis.com)
I am collecting information on companies that make erroneous reports to DAC. Furthermore, I am seeking individuals to file a class action suit against these companies and DAC. The bleeding must stop. I am so sick and tired of seeing truckers take it in the shorts when companies fail to obide by DOT rules and regulations. We make our pre/post trip reports and if the company fails to address the issues we bring up in our reports and we have an inspection at any POE, the driver gets the ticket and the company fires and/or reports the driver to DAC. How absurd is this....extremely arrogrant in my opinion.
Please email me at xxxxxxxxxxxx, if you would like to be a claimant in a Class action suit against DAC and/or the major carriers that report false "erroneous" information to DAC and potential employers.
My mission is to stop the bleeding of the hard working, diligent truckers, and to put in jail the criminals who run DAC and the major carriers. This isn't a pipe dream ladies and gentlemen. I am committed to this endeavor.
I gotta laugh...when i replied to this message i received the following:

What a joke!! Is this site here to help or hinder truckers? With the above message, I am wondering what this site is here for.

If you would have read the site rules when you signed up you would know about this.

This is not to hinder the drivers in any way shape or form, but to cut down on spammers, some thing that is a huge on going problem.

Good luck with your DAC. This is why myself and others tell every one that thinks about hiring with Swift, JB and others to .... "run Forest, RUN" the other way.

We are here to help truckers NOT endure endless spam attacks. It is NOT going to hinder truckers for YOU not to be able to post links...no worries there. Also, we are a FORUM (which means we are open here), we are NOT Gmail. Thanks for reading our rules.

Michael, I fixed your link and allowed it as it is a Government link. Please understand that we are trying to stop spammers and we don't appreciate you coming in here with less that 8 posts calling us a joke because we are trying to keep a good site going here instead of a bunch of spam. We realize that you think you are an authority and should be allowed to link freely wherever you go, but we have rules for a reason, not to "hinder you from helping truckers".
