Here is the conclusion to the Court Case, where the Carrier was found to have violated the ADA act for terminating the driver with a problem with alcohol. http://www.landlinemag.com/Story.aspx?StoryID=25390#.VBb1jfldVX8

Recall, what are the worst ways you had to send a student home. Obviously, when a Carrier Safety Dept. is not fully informed then drivers/ potential drivers will be caught in the middle.

I think the original point of the thread has been destroyed.. I think in this case the ADA is complete ########. NO American company should be forced to employ an alcoholic in this type of position EVER. When the inevitable happens and the boozer kills himself or someone else.. the lawsuits sure the hell are not going to be against the government.. it's going to be against the company that employed and was forced to loose the drunk on the general public.. What a farce!

They were not wrong.. they got sued over nonsense by someone who has no business behind the wheel. The ADA was designed to help disabled people find and or keep work.. this is a abuse of the ADA and anyone with any sense knows that. When some drunk can use the government to force an employer who has to pay the costs of the damage that the drunk will almost certainly do.. then the system itself is broken. This would be no different in the government forcing a day care to employ child molesters in the name of "fairness"..

Being depressed does not absolve you from personal responsibility. It is not up to the rest of us to get you through the system, it is up to you. If a person is not up to doing the job right then it is up to them to get their #### straight first.

Since i started the thread i will tell my story. I am not a trainer but my company is so small that we dont have designated "trainers". So a new guy came on board and i was it. So we drive from SF to Houston and i wont get into too much details but he broke so many laws and was driving recklessly. I instructed him to drive right several times and he just blew me off because he is 30 years older than me. I told my boss and he said he would stand by whatever decision i made so i drove to the nearest greyhound station and dropped him off.

Trainers what are the worst ways to send a student home; Carriers need to be careful or their better judgement will allow the driver to return...to their Company.
