Whenever you have had to work with a broker, how have you addressed the truck ordered/not used situation? Some of the larger brokers are usually pretty good about paying, but there are those that just give you grief. Just today, we arrived to pick up some machinery (per rate confirmation) and the receiver changed his mind after we were there to load and were calling to confirm delivery on the other end. Seems he just couldn't figure out how to get it off the trailer, so he cancelled the load. The broker is balking at TONU stating "well, you were coming through here anyway." True, on the map it looks like a straight shot, but the lost time is worth something, correct?
We address detention time in either the contract or the rate confirmation. Has anyone ever amended either a contract or rate confirmation to reflect TONU verbiage?

On two seperate occassions I was ripped off by CH Robinson for a truck ordered not used. On both occassions they refused to pay, claiming that they wanted me to "lay over" to the next day and they would then "probably" have a load for me. And how much would they pay for this layover? $150. I told them no way, I could not survive on $150 revenue per day and demanded $200 for truck ordered not used. After the second time they did not pay I stopped hauling any loads for C.H. Robinson. CHR represents all that is slimey, deceptive and dishonest about trucking.
In direct answer to your question, after that incident I insisted on spelling out TONU fee and detention pay on every rate confirmation with other brokers. I lost a lot of loads because I would not sign their paperwork without changes. I eventually got out of being independent and I am now a leased O/O. I am making a lot better money now that brokers are not ripping me off. -
You should always get paid in that instance but some Brokers/Shippers don't agree they say "well, you were coming through here anyway" well I never mention anything about what where the truck is coming from to ge to the load. It's none of their Business. -
Appreciate the comments! Good news is the broker did agree to TONU and sent a rate confirmation. We spent less than 1 hour at the shipper and made $175. It was enroute but you are correct, that is none of their business! I definitely will include that on any future rate confirmations and/or contracts.
