Truck stuck in shop 4 weeks. Driver also stuck.

    While picking up my truck at the dealer another driver from my company started a conversation with me about his truck being here at the same dealer going on 4 weeks and they still can't fix the DPF regeneration problems it's having. So I asked him why doesn't the company just put you into a different truck ? He said can't because it's a lease purchase. I said forget the lease purchase just become a company driver. He said can't , it's a lease purchase. He said he was $3000.00 upside down in his payments because he hasn't moved any freight in a month. I told him to just clean out the truck and go to another company. He said he can't , it's a lease purchase. He said it would ruin his credit. I have never done a lease purchase. Does that story sound true and legitimate to you ? Are these lease purchase deals really that bad ? Can't haul freight because the truck doesn't work but still must make payments on the truck that doesn't work plus can't get out of it !?!?!?!?! Yes I know he could walk away from the whole thing but he felt completely trapped in this. Sounds like a total nightmare to me !!! Your thoughts ?

    I doubt it would hit his credit most lease purchase companies if he’s leasing through the trucking company don’t report made payments so they in return can’t post none made payments if they tried it real easy to dispute it on your credit.But they could try to have a judgment in small claims but I would be highly doubtful .But 4 weeks in a shop for emission related problems is not uncommon

    Even if it hurts his credit; so what?
    Walk away and find another job as a company driver.
    Some people love a life full of controversy and hardship and aren't happy otherwise.
    They look at the company drivers with a nice home and happy wife; children doing well in college, etc. as just dumb saps for being a "company man." They think it's just plain dumb to be able to take a nice vacation and not worry about a lease-purchase payment.
    He's $3,000.00 upside down and can easily clear that by cleaning his personal stuff out of the truck and going home.

    So if he had went to the bank and took out a loan to buy the truck and ended up in the same situation, what would happen?

    The truck has been in the shop 4 weeks for issues not related to collision damage. Bank would think he's on crack at the suggestion of buying the truck

    What I meant was what if he had gone to the bank and got a loan instead of a lease purchase how would his situation be any different. He would still have to pay or walk
