Trucker arrested in fatal I-75 N crash in Moraine (Hit&Run)

    One person was killed, as many as three others were injured, and a dump truck driver is in custody following a five vehicle rear-end, chain-reaction accident on I-75 North in Moraine on Wednesday afternoon:

    Several bystanders and witnesses told police they saw the truck try to leave the scene, then saw a man get out and run north along the interstate. Police arrested that man, identified as Evans, on Sandridge Drive moments after he scaled a fence.

    Running is a primitive and futile emotion. So stupid. Add more charges to himself that's all.

    I was expecting far more damage to the front end of that thing. Then again it don't take much to mash people.

    That makes sense. It must some sort of shock they go through when you realize you've just killed someone. What other job creates a murderer out of ordinary people who are just trying to make a living?

    He probably would have lost freedom anyway. Did we not recently hear of a company executive hauled into court charged with the same murder charges as his employee driver in Georgia?

    As a side track, we lost a dear friend when she was exhausted from working 4 jobs and crossed the yellow line head on into one of our local gravel hauling dump truck. All he lost was the steel bumper and bullcage while she got destroyed while changing radio tape deck and not looking... He did not get charged. But after telling us his side of the story while paving our driveway on our land we understood the situation and forgave him. The dear friend is buried far from here because she wanted nothing to do with the husband that put her into that position.

    Taking of human life is a absolute worst terrible thing to do in life. To be branded a murderer after you take a life on purpose is one thing. But if you did not mean to take that life it's manslaughter. If you take a moment and read about Capital Charges beginning with Simple Assault, agg assault and working through the manslaughters into the murders one and two all the way to capital murder you will see in black and white as the law decides what brand of killing.

    A Vehicle is a deadly weapon in the eyes of the law if used as such. Negilgence and other things also play into it.

    Im happy to say that for the most part I never killed anyone, but god knows Ive saved lives over the years or tried to. But due to my training, if there is a active shooter or terrorist I will have no issue taking him out. But the after battle affects me the same as if I just finished a fist fight or something afterwards.

    What gets me is that People are so weak behind the wheel of a heavy commerical vehicle in which they are supposed to be professional as to fall down so hard and life is lost. They should be jailed, if not also fried for what they do. But we are supposed to have due process which will play out in time. A very long time.

    Just an aside note here, the article said the case would be presented to the sheriff's office, by the police department for charges to be filed?????? Seems like they do things way different there than anywhere else I've ever heard of.

    Sherriff is Prisoner Custody or Search and Rescue etc. They can do enforcement. But cases are usually referred to a DA (District Atty) for prosecution decision to prosecute or not? And there is sometimes referal to a grand jury convened for the purpose to decide to indict or not. What I just wrote comes from my own infromation based on a concealed carry draw against a bad guy presenting a threat which will most certainly be referred up the justice chain for possible prosecution. Even if the DA or Jury declines to prosecute me for such a thing there is still the possibity of a civil case suit brought against you by the family, kin or whoever.

    Now if I understand our Constitution, the Sherriff is the lowest level Elected Official capable of a certain range of Powers in time of peace and war when normal Town, County or State Government is non existant for some reason. Otherwise under Emergency management up to and including Nuclear War in our State, the local Circut Judge at the county level determines who does what if necessary provided the higher government levels have been destroyed or otherwise unable to manage the problem. Such as a earthquake etc.

    What I meant was that every where I worked on the job, the investigating agency, whatever it was, presents the case to the district attorney, or whatever that office happens to be called. (With the exception of anything federal.)
    If it is a city or state case, the "suspect" will likely be booked into county jail, but that, and probably court transport and bailiff, would be the extent of the involvement of the S. O. I never heard of a case being presented to the sheriff for charges to be filed.
