DAYTON -- A grand jury has decided not to indict a security guard who, on Dec. 8, 2013, shot and killed a man who charged him at a newly opened Love's Travel Stop.
Montgomery County Prosecutor Mat Heck Jr. says the grand jury spent four days reviewing the evidence related to the shooting death of Goran Sojic at the Love's locations at 2217 Edwin C. Moses Blvd, Dayton.
"After consideration of all the testimony and evidence, the grand jury returned a no true bill, declining to indict anyone on felony homicide charges," Heck said. "The deceased, while speaking a foreign language, charged at an armed, uniformed security guard behind the enclosed cash register area, and refused his commands to stop, which caused the security guard to fear for his life, as well as the safety of others inside the establishment."
Heck said the grand jury considered testimony from 12 witnesses, including police officers, an EMS responder and employees of the Love's Travel Stop and Hardee's Restaurant, which are in the same building.
The grand jury also considered forensic evidence gathered from ballistics testing, autopsy findings, toxicology testing and from security surveillance video.
