A driver who refused to run against his hours says his company wrongfully fired him for it. OSHA investigated the situation and found the company at fault. They ordered the company to reinstate him to his position with the company and also ordered them to pay him $276,000 in back wages.

There are fights that are worth having. Anytime a company tells you to run illegally, it is the time to fight. There are also cases out there where drivers have been fire for making a shipper remove freight that put the load over weight. You will win but you have to be in position to survive long enough to win. It is hard to fight the fight alone. Which is one reason I support OOIDA and other groups.

Some drivers screw around and waste they're hours and then cant get the load delivered. If your doing a good job most companies are not gonna fire ya for one late delivery.

I wouldn't want to go back to work for that company. But the $ is well deserved.
Our guys don't like long hauls because it means more time away from family so I got a couple that try to run out of hours and I have to call him and tell him to stop. Go to sleep, ######. -

I could stand to make millions if I wanted to pick a fight against all those who fired me for refusing to deliver against the log books. And you wonder why I do the things I did with them...

Just curious, back before e-logs became so widely used could you still win a case like this? I'd think it'd be a bit tougher to prove through paper logs, but I guess I could be completely wrong.
