Trucking company says lawsuit by North Dakota couple should be dismissed

    You still cannot make that decision based on the information.
    Yes, he rear ended him, but what was it that the 4-wheeler was doing that was not legal?
    Did the car pull out directly in front of the truck?
    Did he cut him off on a ramp?
    We do not know. So cannot really say one way or the other.
    The only facts we know is that he rear ended him and that the 4-wheeler was not driving in a legal manner.

    I lean towards the 4-wheeler being at fault most of the time because statisticly over 70% of the time the car is at fault. Not my numbers but the DOT's. So I lean that way out of habbit.

    Well, you're aware that someone can cut in front of you and leave you no room to stop before hitting them. Some guy in a brand new pickup did it to my dad and totaled out the old pickup dad was driving. He had no time to stop. That can happen to any of us at any time. We all know that. So we can all park our vehicles, trucks or otherwise, or we can go on and hope it isn't our turn yet.

    Thats why Eaton Vorad is awesome in situations like this. If your sensor on the front of the vehicle is not sensing anything then somebody cuts you off and it senses something about 15 feet in front of it and then senses a massive loss in its speed you can record all of that by preesing and holding the 2 buttons for it in your truck. It saves drivers and companies from being sued all of the time.

    So your saying the car could not have cut him off and then slammed on the brakes or something? You right floowing distance is key along with paying attention, but, I've had it happen to many time to keep track of and some that ended less than inches from hitting these douchebags! People do it all the time pull oyut in front of you or cut you off and then a green light changes from green to red and they lock up the brakes to stop, some even at the same time they are cutting you off. It's not alwasy the rear enders fault but you can guarandamntee it will be charged that way.

    I made it 4million miles without tailgating or killing anyone.Thanks be to God for giving me common sense how not to tailgate.I was reckless as hell on a motorcycle but the risk was more on me then.

    My question is how can the same guys who are constantly whinning about dem #### 4 wheelers later be involved in a accident with a 4 wheeler when he knew what might happen in advance.

    I drive local in an area from NYC to Philly, it is a very rare thing to see a truck at safe following distance. I see more and more truck trying to push cars to go faster or mover over at speed 10 over the posted limit everyday. I have been tailgated by other trucks at close to 10 over the limit, I have had trucks cut in front of me with just a few feet between the trailer and my front end. Other trucks are just as bad as the cars.

    If I every get rear-ended by a big truck I will be a rich man, I will sue for everything I can get.

    I-95 is like that from the top to bottom except for the "times" I was on it.

    I'm not talking about tailgating. I thought referencing someone pulling right out in front of you made that obvious. I don't care if you have 10 billion miles under your belt. If someone jumps out right in front of you, you're as done as anyone else.

    we are ready for them to pull out.When we see them a half mile away we say to ourselves I bet they are going to pull out,so it doesn't surprise us when it happens.

    This how you get through a career accident free.
