unfair charge for unit damage caused driver

    If you are being paid on a 1099, then the contract you signed will probably screw you. Are you 1099? What does your contract say about this?

    And you can likely kiss any chance of ever seeing you escrow again goodbye.

    Good points. Even with being paid 1099 and a contract he could win. I was paid like that but not as a driver and won without an attorney. Just being paid 1099 and having a contract does not make one an independent contractor. It is the underlying relationship. There are Federal rules and the rules vary slightly by State but are mostly the same.

    Not to add insult to injury by asking, and not be a ########, but would you rather them end up with even more of your hard earned money being kept by them if you continue working for them?
    Form SS-8 from the IRS can be a beautiful thing. If not to rectify your situation then to definitely create some problems for the company.

    Worth a shot but don't count on it. My case was clear cut but the employer lied and the young dodo for the gubberment ruled against me on the SS-8. Did not understand the rules. State employees are just as worthless and incompetent. Won the 1st round for unemployment and then that was reversed and it took 2 years. Once I got an attorney for Circuit Court the state jumped on it within a week and it was sent to the highest appeal level where I won. But it should have never gone that far. Basically 18 yes or no questions that were all clearly in my favor. A few: Did the worker have his/her own business; advertise; hire others; have own tools or equipment; have workers' comp or liablility insurance or both...... Had at least 2 others that I won on my own. One may ask, why would you work 1099 again? Because I needed to work and that is the only work I could find and the employer would only pay 1099. It's not only in trucking, there are dirty employers all over.

    I’ve only been driving for 7 yrs but have not heard of a company doing this, unless the driver was malicious in doing so
