Triple Six, reread the first line of the OP. The newly hired driver was training his friend who had just gotten his CDL. They both had CDL's, but the second guy wasn't an employee. The first, newly hired guy, was letting his friend go along and he was training him, behind the owners back.
As has been posted, the insurance will cover the damages, sue the two guys, and surely cancel the policy. AND, the owner may have problems getting a new policy, and or pay a very high premium, if anyone does insure him. -
If I hopped into a CMV in Arkansas and the state police corralled me and wrote tickets I lose my car license 120 days. Meaning no CDL at all in the CMV when caught. Now if there is a accident, speeding and other problems the charges stack and stack.
But I wont go to jail for being in a CMV with a car license. Now... one can argue that I stole it then that will be different.
Fines certainly. About once a month we catch no CDL in a CMV in our area.

What kind of an idiot let's his friend with no license drive. Either way, he should have his CDL yanked for not taking his responsibilities seriously. What is he a third grader?
Oh sorry he had a license, but in this instance that's a small formality. He had no business letting him drive. What made either of them think the new driver was qualified to train. I smell something more fishy here.pattyj Thanks this. -

I own a trucking company and I know all about MVR submittals to the insurance company to add drivers.
In the end they are required to cover the accident and yes the company will drop your insurance coverage at there first available opportunity.
Also good luck getting insurance after this because it will be a matter of record that they were dropped for an accident with an unapproved driver.
Insurance is all about risk that's why they ask for MVR reports and social security numbers and believe it or not even financial back ground on the owner.
They do all this to help mitigate there risk.
But in the end they still need to be prepared to cover some company doing somthing stupid like putting an unapproved driver in the seat. -
