Unique question about PTO

    If I take vacation, then I immediately quit the day I get back, can my company withhold my vacation pay?

    Depends on what the employee handbook says about that.Some companies require a worked notice to be paid for vacation time .Don’t think there a law where the police can make an arrest about vacation time

    in my state PTO you have earned is counted as unpaid income the employee is owed, whether fired or quit without notice doesnt matter you are suposed to be paid.

    no, it is earned time. a company can't hold the money.

    Only 20 states require the employer to pay if you don't return to work.

    Sure they can, at least in wa. If a driver is fired here, they do not get the vacation pay. That’s why I cash mine out the week it’s earned. Ain’t no reason for them to have the money when it could be in my bank account.

    op I personally would wait until the money is in your account.

    A week or so after my anniversary date I get my vacation pay direct deposited.
    I'm not sure what would happen if I quit just before the payout, but if I quit before the anniversary date I probably would not get it.

    If you time your vacation to coincide with when they pay the vacation pay it would not be a problem. Ya?
