My manager (a former driver of 30 years) still gives me some nonsense answers about H&W. Looks like they "trained" him well.
After 4 months and not a $0.01 of H&W pay I had enough and called the local department of labor office. Talked to a lady that didn't know much about it. She took my info and someone called me couple hours later at 4:30 on Friday.
I was told that I definitely have a case and someone will call me Monday to file a complaint over the phone and they will investigate the company.
Will keep you posted of the outcome. So if someone find themselves in the same boat you'll know what to do.
We need to fight companies like this.

I'll be curious to see how that plays out. I have no preconceived notion on it, just curious.

My company says that they have to pay employers tax on our h&w. Unless of course we pay for their expensive group plan insurance. Was $1900 for me + family! They told me to just put myself on their ins and get obama care for family. Yeah i get it $560 a month for just me is better than 1900. Except when you figure my obama care FAMILY+ ME h+w was $362. Some companies make you put whats left over after your ins premium into their 401k. Bring on the robo trucks. I've read the davis bacon act and another one with #'s. Its legit. Nothing we can do about it.

My company pays h+w to part timers but they aren't forced to buy the company's insurance or 401k. We've had drivers drop down to part time just so they can keep the xtra $5/ hr

Three months later the H&W case was assigned to a local investigator. So they are working on it. Just moving slow. DOL is a government agency after all.
Meanwhile I had enough of this clowns and filled some applications. Got hired by OD as P&D driver. Have been there for a little over a month. Great experience so far.

The pay is good and the benefits are good, but a really tight schedule.

It's been many years, but I used to do a run from Phila to Cincinnati. The schedule was so tight that you had to run it basically nonstop. A bathroom break longer than a fast stop could make you late.

Runs that were shorter were the same. Just enough time to get there. If you stop for coffee- RUN!

I'm sure it's better now with the mandatory break.

But if you arrived at the postal facility before your appointment time somehow, they would make you wait until after your appointment time, so you could never get ahead of things.

It wasn't hard work, but I didn't like being on the run always and driving fatigued. Not for me, but some guys loved it.

This was finally settled after the Department of Labor was involved.
The owner of the company called me, apologizing and blaming it all on the local terminal manager.
I received a check for about $4,200. H&W is $5.03 /h for up to 40 hours a week. I was with this company for 5 months.
So the H&W pay starts from day one and you do have the option to get cash and not go for the insurance or 401K they offer.
If your company is forcing you into a 401K, insurance plan you don't want or in my case telling me that H&W pay starts after 1 year contact your local Department of Labor. They are slow (too many cases to handle), but once an investigator gets on your case they will get to the bottom of it. You can stay anonymous, if afraid of loose your job.

So did the Department of Labor say that they could not force the 401 k? If so that's going to be good news for a lot of drivers. And bad news for a lot of companies that have been doing that. I'm glad mine doesn't
