Some of the conclusions being jumped to in this thread is as bad as the media.
NJ.com posted a big headline stating he had been on duty for over 13 hours. Not one time in the article did it mention that was legal.
Yes it looks bad and I won't be surprised if he was at fault but as one who runs that road quite often I promise you nobody was going less than 60, which in itself is a problem. Somebody was going to screw up bad one of these days on that road and this driver hit the mother load.123456 Thanks this. -

Although I agree, the ironic part of all of this is that IF HE WAS running 45 mph, there is a good chance some 4 wheeler texting would have run right thru the DOT bar up to the tandems, and then the truck driver would have gotten blamed for impeding the flow of traffic.Roadmedic, joseph1135, peterd and 2 others Thank this. -
And of course a big deal will be made about the speed limit although as stated he was almost definitely going along with traffic flow. The speed limit is not really enforced on the turnpike but nobody is going to mention that.
all this does not excuse the rear end collision but throwing this guy in jail for the above reasons is blatant hypocrisy.pearcetrucking and KANSAS TRANSIT Thank this. -

Some of this sounds odd.
Whenever I drive through a construction zone (never more than 4mph over), I am the slowest thing on the road.
Additionally, signs identifying construction zones and lowering the limit are not always reliable.
Signs turned over, around.
Is the lane closed or open ? Did the construction workers change the signs B4 going home ??
How many times have signs directed a lane change/closure, and several miles later you find the lane is not closed at all.
Have you ever found yourself driving 45 several miles after the construction is passed. Because no sigh indicates the construction zone is over.
And exactly what is this amorphous sign "when workers are present".
I can go on like this for a while.
I can imagine Walmarts attorneys making a compelling argument in defense.Last edited: Jun 19, 2014
