In response to the threat of litigation by the OP's legal team, Walmart decided to settle out of court. They will pay the OP $3000.00 for his "pain and suffering." The op's legal team will take 40% of the settlement amount.
The Walmart employee was fired and is now looking for work.
The OP has seen a sharp decline in his dispatched mileage and is having a difficult time keeping up with bills on his meager paychecks. He is currently applying to other mega trucking companies, but they have shown no interest thus far.
Walmart manager hit my leg with metal dock bar. Serious Suggestions?

I totally think recording anyone trying to work is a dick move. Unless we're doing a TV show for Discovery Channel you can screw off with the camera. I don't like being recorded, therfore I don't record others. Besides, I have actual work to get done. I don't get paid to film.

UPDATE FOR EVERYONE.
law firm that I spoke to in person has agreed to take my case. I woke up to find that they left a voicemail asking me when is a good time for a couple of their people to come over to get all of the paperwork sorted out. I will be handing over all documents and the footage to them tomorrow morning.
To my surprise, I also received two other voicemails from two other law firms this morning that I have never even spoke to. How they got my number is beyond me..
I’d be lying if I said i’m not nervous. Again, this is my only source of income and I was already told to keep this under wraps by Walmart as they would take care of it, but I trust a lawyers judgment to go forward with this.

If it goes to a jury you can get an idea of how it will play out from the commments above. Most people are not going to be sympathetic to a jerk that videotaped a guy "having a bad day" because he thought it was funny, what with the guy being overweight and all...Roberts450, Dumdriver and MachoCyclone Thank this. -

I’m not the one who threw a metal pole like Barry Bonds swinging for the fences in his heyday.
That is entirely his fault. Him being filmed does not give him any right to throw a pole at another person like a maniac. He caused physical damage. My camera filming did not. And besides, I’m pretty sure he didn’t even know I was filming him. It’s not like I was holding the camera to his face.
But it’s no longer up to me. It’s in legal hands now. They have assured me they will handle it accordingly.Last edited: Nov 12, 2017

The argument that you should have been doing your job instead of being distracted by recording something you found "funny" can be made against you.
