Walmart manager hit my leg with metal dock bar. Serious Suggestions?

    On a serious note though are you allowed to be on the dock there? From what I read a lot of places don't allow drivers on the dock for insurance reasons. Now if you claimed you were injured by a dude throwing a javelin at your leg all Walmart has to say is you weren't supposed to be there anyway.

    I don't know just saying pretty fed situation. If it we're me I would have threw it right back in disgust yelling a bunch of obsenities from pain.

    My experience doing Walmart runs for Swift on the dedicated runs (helping out when dedicated drivers took a day off) is that you had a few stores for delivery. You had to be on the dock to observe unloading and make sure only the pallets for that store were unloaded, and secure the remaining pallets before pulling out.

    You did the right thing by going to the hospital to document this. Take care of your self and this situation.

    Ignore bad information from Swift and Walmart, their just trying screw you and deny any claims.

    File a works comp. claim right away. I do think it will have to be in the state your home terminal is in. But, find out ASAP.

    Insurance is probably taking care of this now, but their will be co-pays and out of pockets for this and it shouldn't be on you. Get the claim ASAP so all billing can be referred to the claim number, the company, and not you.

    Stories will change and people will deny. But stick to your story and keep it simple on all the forms. I am not say their is a problem with insurance or works comp. but in these things BS happens and the injured is often blamed no matter how blatant the incident is.

    At this point I don't see any need to wast money on a lawyer. This is a workers comp. claim and all expenses will be taken care of through insurance or work's comp. But keep your story simple - get it?

    A lawyer is not going to be able to do anything unless the Work's Comp. claim is denied - and it won't. But you have to get things started in case there is some problem with the medical payments or any down time at work.

    Filing the Worker's Comp. Claim will provide you with some protection against retaliation from an employer. Most states have protection laws that prohibit an employer firing or retaliating against a worker's comp. claim. A lawyer can defend you with a claim. Without, someone just might look hard to find fault with you and filing a claim might be too late.

    Injury on the job, workmans comp. Find a lawyer and turn that video over to him.

    There is a potential pay out for you vs walmart when they settle up with that hot head. Otherwise charge him with battery and take him to court for your medical charges...

    But workmans comp is first. Video is priceless to them. I think once the cash flows your way you might feel pretty happy.

    What I call this is a great example of instant karma. Maybe the first thing you do, shouldn't be to grab your phone and start recording this guys meltdown.

    I second this. I would find out of there's something wrong. If so take action accordingly. I don't think I would "lawyer up" unless it calls for amputation or something lol

    Thank you all to the people that actually chose to help me instead of attacking me.

    That guy was in a bad attitude to begin with as soon as I walked to the back room. Of course I wasn’t going to help him with anything.

    The guy starts acting like an idiot swearing at the top of his lungs about how he hates his job and decides to take his anger out on the electric jack by giving it some hard hits. I know you hate your job, but show some professionalism like all the other unloaders at the hundreds of other locations. I’m sure a good number of them hate their job as well, but at least they carry themselves with professionalism.

    I don’t want to hear your problems, but I certainly will pull out my phone and record, because there is no telling what he is going to do next seeing how unstable he is. I simply pulled the camera out because I found it intriguing, but above all, I wanted to protect myself from someone with such a bad temper and sure enough...... he throws a pole towards me. He didn’t casually throw it either. He literally threw it with all of his might and I was injured in the process.

    For the the people here attacking me because I was filming him.... he was already in a bad mood long before I pulled the camera out when he started yelling and hit the electric jack.

    He was a fully grown adult throwing a tantrum like a child. Since when is such behavior acceptable in the workforce?

    But what nobody has said in all these good treads is: if you ####ed up Wal-Mart and mega would can you. So it is a fifty shot at what you decide the best action is.
