Wanting to hire drivers. Need advise!

    From a legal standpoint, you should be providing W2's to your drivers. As states above, 1099 are for independent contractors. It would be hard to convince the IRS he is a true independent contractor when the driver drives your equipment.

    Facts that provide evidence of the degree of control and independence fall into three categories:

    1. Behavioral: Does the company control or have the right to control what the worker does and how the worker does his or her job? (dispatching)
    2. Financial: Are the business aspects of the worker’s job controlled by the payer? (these include things like how worker is paid, whether expenses are reimbursed, who provides tools/supplies, etc.) (Tools and equipment are provided by company)
    3. Type of Relationship: Are there written contracts or employee type benefits (i.e. pension plan, insurance, vacation pay, etc.)? Will the relationship continue and is the work performed a key aspect of the business? (You may not have any of these as a small business, but certainly might as you grow)
    Easiest thing to do it use a payroll service. You don't need incorporation although you may want to incorporate. Incorporation has nothing to do with how you pay your employees. A payroll service will take out necessary taxes for you and file w2's. You can also use form ss-8 to determine for sure weather you have an employee or independent contractor. http://www.irs.gov/pub/irs-pdf/fss8.pdf

    I appreciate all the feedback from all of you. I think I'm going to give an accountant and attorney a call and see what I can get set up. I wanted to speak with people like yourselves before I did so that way I had a little more knowledge before speaking to an accountant or attorney. I've done hours and hours of research but it makes it easier hearing from people that has experienced it first hand. Again many thanks to all of you!

    1099's are the way for you to go.

    Until you get questioned, or have a problem.
    In the past, it worked out very good to use 1099's. Anymore, unless you are doing it on a true contract basis ( which I have done ), asking for trouble.

    you do relize "get questioned, or have a problem" generally comes with strict penalties. Just read the irs links i posted...there's your answer

    I do now, Sorry I don't get sarcasm until someone points it out lol. It kind of didnt make sense before since you kind of contradict yourself...now i get it lol.
