Well it finally happened, someone hit a parked truck on I-78 in NJ

    Actually he's right. If he hadn't lost control, he wouldn't have hit the truck. Had the truck not been there, everybody could have been killed when the car left the highway at 70 mph. Everybody could have killed when the car rolled over. There are countless scenarios for this to have been a fatal accidents not requiring the truck to be there. Everyone of those scenarios relies on the car losing control.

    It is illegal to park on an Interstate unless in an emergency. If there was no emergency, the driver and the trucking company will be facing some serious problems. You can think up all the hypos that you care to, but they will not amount to a thing, only what actually happened will be the bottom line.

    That might float. But I will guarantee you that if the family of the deceased hires the right lawyer, dont think that is not going to happen, the reason why the truck was on the shoulder will come out.

    Now, how would you feel if you were the driver of the truck and knowing that your action contributed to the death of 5 people? Think you might have trouble sleeping??

    You are speculating and assuming that he was parked instead of being on the side because of an emergency.

    Again this is a poor example. If he has broken down, or pulled over some other emergency, then it's OK, the family wouldn't have hit him? The only variable that changes the situation is the car not losing control.

    I think I'd feel about as guilty as the TREE he would of hit if I wasn't there.
