Yeah, that is the solution that is used most of the time when it doesn't work make the paperwork work to the current situation.

I am picking I guess this morning just because there was some lack of information and that is the thing with how carriers and enforcement will handle it. My biggest beef is drivers with regular trucks parking in spots reserved for large loads I know there is a lack of parking in a lot of areas but it is much harder to park oversized and long loads. Mind you have parked on side of road with a load that weather caused a major problem with and sat there for a day and a half with police on both ends of the load because everything went wrong despite 6 months of planning for this move. Even the best laid plans can run into major problems.
There is no exemption for the 14 hr window. After 14 hr you are done. The exemption applies to the 11 hr driving time it may be extended by 2 hrs to 13 hrs of driving in extreme circumstances that could not have been anticipated at the start of the driving period. Once you cross the 14 hr total on duty window you are in violation period.

LOL Just a thought since this thread has me thinking, do any of you drivers dog ear, use post it 's or high lite mark any of these rules in the book for your advantage should you be called on the carpet for said violations.
This rule would be a perfect example of a dog eared page with that sentence that Grumpy highlighted to be marked for quick reference.
I know it's all in the interpretation of the rule and DOT has the upper hand but pointing something like this out to them if the need arises may get the driver some slack --(Maybe) -unless it pisses them off.
If the drivers that have to live by these rules are confused by some of them -then i would bet the DOT is just as confused. -

And I agree with Double Yellow & Maverick. I agree wholehearted. While I didn't highlight that part, I should have.
The topic is about going over drive time in this situation where the road was backed up or shut down due to an accident.
The 2nd issue of the thread also included how long you can drive in this situation &
3rd, what should the driver have done.
Again, I should have highlighted the 14 hr rules as well.
In the end, I still say the drive did all he could do. I would have done the same thing. I would drive until I found a safe place to park.
1) if the driver had parked on the side of the road, DOT would have made him move. Parking here would have put him at risk of getting hit etc, etc... & not been safe for him or others.
2) if the driver had parked just anywhere in the weigh station, & blocked the drive etc, DOT would have made him move. Parking here would have put him at risk of getting hit etc, etc... & not been safe for him or others.
Either get a ticket or involved in an accident & park illegally... OR drive on to a safe place & chance getting a ticket.
Catch 22..... The driver did the right thing in the end... Rules or NOT....... the driver did the right thing finding a safe place to park.
This subject could be argued until the cows come home ... & there are always variables. But, under these circumstances, the driver did the right thing... IMHO"Hang - Man" Thanks this. -
Yep Grumpy,I also agree that Calregon did what he/she could do.
If it breaks the law "oh well" after all speeding, and fornicating, urinating, and defecating in public are all against the law too- i am pretty sure i broke at least 3 out of those 4 laws. -

This is a good thread. It takes a good look at a good question, and is free of outlandish claims and pissing contests. It would do any driver good to remember, highlight or dog-ear your book with references to these discussions that are factually based. That's assuming you have a book, you use it when you need an answer, and don't rely on "another driver told me..."Gearjammin' Penguin and "Hang - Man" Thank this. -
