To people considering Werner, here's a copy of a letter I sent on Dec. 31, 2009. I expect their policy is a product of self-insurance dweebs allowed too much naysaying power in their HQ.

To Werner:
I recently responded to a Werner request for me to file an application by filing an application online and phoning recruiting.
I was informed that Werner refuses applications from anyone who's had a DUI during their lifetimes.
In my case, my DUI was over twenty-five years ago, and since that time I've been in recovery, in AA, absolutely free of alcohhol or drugs. I've worked with many employers who've had employees with drinking problems. I've counseled these employees and many others in my office, in prisons, in hospitals and institutions.
Your policy is absurd and neeless. It's effect is to disqualify some of the best possible employees you could find by excluding people who've acknowledged and recovered from their problems.
I intend to disclose your policy on the Truckers Report forums, but I also will candidly report your response to this email as well.

I believe in the policy, if it was my company I would not hire a person with a DUI or criminal record. Before you start calling me all name, I do think that I small percentage of do learn there lessons. But, the vast majority do not.

It's their company, It's their truck...They can hire or not hire whoever they choose for whatever reason they choose.

I,too,have run into this problem,as when I was 20 years old I got a DUI,or,DWI as we call it here in MN.Now,Im no going to get long winded on this(,I hope)but who reading his now,who has a few years on them,(I am 50)is the same now as when hey were 20?? For all you holier than thou"s,can you honestly say that,in your life,you have never had 2 beers in an hour and drove your car anywhere? That being said,any company can make any rule they want,that is fine with me,but from what I have read and heard about Werner,if one is not drinking going in,-one will be when they leave!! LOL

FMCSR 391.41(b)(13) speaks to the issue of "current diagnosis of alcoholism". Seems to me you've got grounds for appeal if you were denied a CDL, but as has been said, a company can deny an applicant for many, many reasons of their own making. Recovering alcoholics and recovering substance abusers are not in any of the so-called protected classes.

Many companies are not hiring people with DUI's no matter how far in the past they were because they don't have to hire them.
If I was going to hire a driver for my truck and had the choice between two equally qualified drivers wit the only difference being, One had a DUI 20 years ago, I'd go with the guy without the DUI.
Why thake a chance when a better option is available?
Maybe they're actually considering that...Plenty of people that used to have a drinking problem have fallen off the wagon after many years of sobriety due to stress.
That would be a part of my thought process during consideration of the above mentioned 2 equally qualified drivers. -
I think the point should be a company can hire who they want not. it has become some kind of rule that if you apply they must hire with people today. I understand that people make mistakes, but I also know as a business owner that I had to set certain standards that were not popular , but thats life you live love and leave it or you hate it.
